if you only have 5% left on one side while the other one is flat just change both. Don't get 1 side 70% and other side 5%...I'm not sure how the "drive" will be and how the car will handle but I'm sure there will be some implications.

im probably going to get two new rear tires and wear them out in 3 weeks before my winter tires come on
what would happen if i got 255/40/18's? because i know stock is 255/35/18. is this not recommended?

Just replace the tire with no tread remaining and continue with the tire with 70% tread left on the other side. Chances are the new tire will wear out at a quicker rate than the 70% tread one again, possibly due to driving style and pattern, which means you'll quite likely end up having both tires ready to be replaced at the same time next time you need to get new tires.
PS: It's tire tread, not wheel tread. Cheers.
