I'm back.........in black!
About a month ago I was involved in a multiple vehicle accident, which resulted in this thread here:

Well, after a month of driving rental crapboxes, my insurer has declared that my car was indeed a total loss. Settling up was easy as I had only had my car a few months and so I received what I paid for it. There are some things that I am definitely out of pocket for however. The largest of these is the fact MB is one of the few manufacturers that deems their extended warranty as fully paid on the day it is purchased, and so they would not refund that money even though it had not even kicked in yet. Most companies will either refund your cash on a prorated basis or let you transfer to your new car The other crappy thing is that I no longer have my awesome .9% financing. I'll probably receive a ton of advice on that, but the deal for the new car is done and I just negotiated accordingly. Intend to pursue the insurance company for the driver who rear ended me into the car in front for all those miscellaneous out of pockets.
And so I am back.........in black.

I bought a 2009 with about 16000 miles, pretty much fully loaded. It has the P30 performance pack, premium pack, backseat pack and the carbon fibre trim package as well. I think I have it covered there - I may have missed something in my writeup but this car basically has everything available that year. The dealership was very very cool about the whole thing. I literally called my sales guy the day it happened and told him to keep his eye out for a clean one and when this came in the back door they immediately flagged it for me and held it for 3 weeks while I waited to hear if the first car was toast.
My apologies for the crappy phone shot. Once I get some mods done and we get a decent day I'll be sure to put up some more. I also got a new Hero HD2 for Christmas and so I'll get some action stuff too, I'm sure. Weather has been pretty crappy and I haven't driven a whole lot, but my first impression of the P30 suspension is that it is definitely firmer but not unbearably so. It does seem to lighten up when you speed up. So if you hear anyone complain about it you might want to tell them to drive it like the AMG it is.
On the plus side my insurer did let me keep the mods that I had made where I could return the stock pieces. This included a brand new pair of Conti DWS A/S's and more. Since the first car had brand new rubber, as does the new one, I now have 3 brand new sets of rubber - or in other words - a 3 month supply
Thanks one and all for your kind words and support over the last month. I can testify that this car definitely has a drug like effect, and one that I was jonesing for big time. Once you've had it, you'll do just about anything to get back to it. For me, in the space of 90 days it turned from a want to a need and without an AMG I just felt like someone shot my dog. As a friend of mine said "if it was a woman, I'd really have to consider cheating". The one thing I kept thinking over and over and over is "the people think that a car is just for getting from A to B ain't never driven my car".
All that is behind me now, and so is the traffic!!!!!

Very nice! I've got the exact same car.
That's a load of BS about the extended warranty though. Hopefully someone on here can contribute some useful advice on what to do about that.

My guess (very well educated) is that the MB accountants do not recognize the all of the money received on the insurance policy on day one but rather over the life of the policy (in fact specific accounting rules ensure this happens) so by default a portion of the policy has yet to be recognized as revenue. Read the small print of your warranty to see what happens in the case of termination....if it is silent on terminations or cancellations you have a case, if it specifically states no refunds then you are screwed.

I purchased an extended warranty from MB for my C63 which I bought used (one year old). I was told at that time that I could get a full refund if I did not use it and terminated it before the original warranty on my car expired. After that I was told it was a prorated refund. I hope they didn't lie to me, I'll have to check that out. It was a big incentive to buy it as I still had 3 years on the original warranty and typically don't keep cars that long.

I have read the contract and it does say that it will be considered 100% redeemed on the day of purchase and that it can't be refunded. It can be transferred to the next owner tho. When I bought the warranty I never considered what happens if I total it. I still would have bought it cos I've never totalled a car before. Given that other manufacturers do it, it just really felt like a kick in the ***** that MB Canada cash grabbed me for 3 g's at the absolute worst time.

I had the same issue with the extended warranty with MBZ. They would only refund the prorated portion of the warranty premium after they deducted any amount of warranty claims against it. Since I had a claim on the extended warranty that exceeded the warranty payment, I got no refund and my insurer said it was not covered under my policy. The good part is I got high retail blue book, sales tax, and registration fees on a C55 I was getting ready to sell anyway. Basically I ended up over $5k ahead.

I also replaced my 2008 Black/Black totaled with a 2009 Black/Black.
I remember how bad I felt during that month in Limbo between when the accident happened, and when I picked up the new one. a very uncomfortable and uneasy time.
