Yea and they hire their own who low ***** you (ive done this twice much easier to hire the lawyer and you can negotiate much better than 33%), good luck trying to get fair diminished value by just having an appraiser I tried that. The other insurance even tried to deny diminished value was real, they dont want to pay out. You also have to factor in loss of use of the vehicle, aka make them pay your monthly payments while its in the shop if you have a loan.

I've been rear ended three times in less than three years and my insurance paid on two of the accidents. Crap insurance for the other party make it difficult to drive a nice car in Texas. Good luck with your claim.
