Got Rear Ended Tonight

So how bad do you all think it is? Repairable or totaled?

I would think definately repairable but I think insurance wise would also depend on year, mileage and any other history with it.

repairable. won't be cheap for the other guy's insurance, but I don't think it would exceed the book value of your car. i'd think around $15k repair job.

make sure the shop checks underneath the panels for frame damage. also, if fixed, be sure to submit a diminished value claim against the other guy's insurance co.

Its a 2009 with 32000 miles on it.

Def agree with this part. The deminished value part saved me a whole lot several years ago.

Definitely repairable, however maximus is right on the money, diminished value claim is a must.

Yes it was a Ford Explorer, and he hit my so hard he veered off over the median and into on coming traffic. Lucky for him there were not cars going in the other direction at the time.

HAHA I am trying to work that out. I am ok our cars are tanks. the car took the impact like a champ. I didn't even move out of my lane!

I got rear ended same way as you by an SUV. Repairs cost me upwards of $15k. Though I think it could had been done for $10k. The rest were markups by the fancy body shop I took it too. Seems they work on alot of ferraris, lambos, and euros. I figure insurance was paying so I took it to the best.

If you have the option of finding out, see how far out of alignment the wheels are BEFORE it gets taken all apart. Sheet metal is easy to fix, but if the frame is bent, it's never going to track straight again no matter what they do to it. Good luck - I hope the damage is only cosmetic.

P.S. If you got rear-ended, it's not coming out of your pocket no matter what.

Doesn't look to me you were rear ended.
Did the guy admit fault? I had a similar accident in my C CLass where i was hit in that exact spot and the other driver claimed i wandered into his lane. I had a passenger in my car that backed up my claim that he nudged me. We were found both at fault 50/50. This was in Aventura FL.

Officially Florida does not recognize first party diminished value claims (meaning claims against ones own insurance company) Florida does recognize third party claims whereby a vehicle owner may seek recovery against an at-fault driver for their negligence in causing the loss of value.

Yes the guy that hit me was at fault according to the officer on the scene. Thanks for the info on the diminished value claims. I have been researching it and it seems like a royal PIA.

Compared to the idiot who rear ended me this is a scratch you can buff out. Insurance wont total unless its approaching 90%+ of the value. My poor car suffered $14k-16k in damages I don't recall off the top of my head but with rental car for 3 months the total was closer to $20k.

And find a diminished value lawyer, you will also have to get an appraisal for a specialist in diminished value the lawyer can refer you to that. Its a PIA and they will fight it all the way, get the lawyer and let them handle it we are talking $5k+ easily off the value of your car.
