If the 08's and 09's could stay in S mode, there has to be a way to update the software to be able to do it in any model. Now to find the setting. We need a CS major in here!

2010 is the first model year where MB defaulted to C mode upon start up.
2010 was a transition year. P30 was offered until December 2009. P31 became the default option at the beginning of Jan. 2010.
I hope this clarifies any confusions.

All 08's and 09's will remain at S or C mode, depending on the setting that you were last on when the car shut off.

A quick way to differentiate the P30 vs P31 cars are the red calipers. Alcantra wrapped steering wheel is another way, but not all P30 cars were spec'd with Alcantra wrapped steering wheels. Since you have an 09 car, you definitely have the stiffer suspension and lsd packaged performance package car.

The W204 is covered under Xentry and not DAS and developer is not available through Xentry. I think that is why only 2009s have been modified using DAS and you have to have an older version of DAS to get any W204 coverage. Not an expert but that is how I undrstand it.

mort, you can access w204 in das developer in 2012 and prior versions of das/xentry. w204 has to be unlocked which can be done with a passcode or enabling it as a prototype vehicle in earlier versions. there's a lot of threads about this on *******.
there's a video that kind of explains this (using das for w204, not the startup mode specifically) on youtube:
