Exactly. Spot on. Pays to play nice with people. 4k miles, wear and tear item, accident on who knows what side at who knows what impact speed (OP words are meaningless - police report or detailed writeup by the MB authorized bodyshop is all I would go on if I were MB), potential hiding information from dealer, etc. All of this contributed to your current situation. Now live with it, or go lawyer up.

Now can we please let this thread die so the troll can go away.

I know that there is more to this story, but can a dealer refuse CPO warranty service if you did not purchase at the dealership?

I am considering a CPO (local nd cross country) and am paranoid about the dealer trying to screw me on repairs.

Nope. You'll be fine, it's an MBUSA warranty, not dealer specific.

I had this happen on a SVT Focus a year after I bought it new. Had to take it to another ford dealer

Now my brother got kicked out of a Land Rover dealership and my brother in law kicked out of a Nissan dealership, both for getting angered by mysterious damage showing up after service and jerking them around with work. I would think that if work qualified as warranty, things would be copacetic. I have had dealers give me the benefit of the doubt and argue on my behalf for coverage for transmissions, tires, turbos, etc, even after warranty expiration, so I have a hard time imagining these horror stories.
