I'm confused now. I think you mean W204. That's the code of your C63 model. The engine code is M156 which is the 6.2L NA engine for the C63.

Yes, that is what i meant but i dont think 2009 engine is compatible 2011. Correct me if i am wrong..

it is. 2008-2014 should all be the same I believe.

even some of the older e63/cls63 engine's (before they switched to the bi-turbo versions) should be compatible.

Sure. I could type a book, but I type slowly, so I'll summarize a bit. First, every offense, criminal or civil, has certain elements that need to be proven. Fraud and theft are not even close to the same thing. Fraud involves a statement known to be false with intent that the other person rely on the falsity. There is such a thing as civil theft, but I'd have to look up the elements. Hiring an attorney to file criminal charges makes no sense in most contexts and most jurisdictions. Ok, I can run with this....

He IS the victim of fraud, 107%, no ifs ands nor buts about it. He was offered a warranty for a specified amount. The dealership accepted the funds and then made the conscious decision NOT to supply those funds to the 3rd party warranty company, thus meaning that they did provide false and misleading information with the intent of monetary gain WITH intent.

Laws governing the actions that can be taken by the injured party can vary greatly from state to state, as I would hope you would be aware. This is why i stated that IF it were me I would seek the services of a reputable attorney near the DEALERSHIP itself as they should be most familiar with the state laws governing the jurisdiction where the dealership finds itself. With this in mind that attorney should know where and with whom any actions would need to be initiated.....

This is not a pissing match nor will I participate in one over a de minimis issue such as this message board banter....I also will not back down from the original opinion I put forward, it is sound and would serve well no matter where administered....but I, along with everyone else appreciate the input and opportunity to squid pro row

I don't view it as pissing match, it's just a discussion. He may very well have been a victim of fraud. I didn't mean to suggest he wasn't. But not as you describe it exactly. You'd have to prove they knew they were not going to apply the money to the warranty at the time they said they would. Maybe so, maybe not. Therein lies the rub. And the deposition of the guy to find out will cost about $2,000 not including the lawyer. But don't get me wrong, if he hired me to represent him I'd assert a fraud claim, and several other things. There's almost no question if you actually tried the case you'd win on some claim, even if not fraud. Conversion, civil theft, outrageous conduct, whatever else I could think of. But that does not change the fact that you are running after a probably empty purse in bankruptcy.

Personally, I'd have a tough time ditching the car. I'd probably look into an engine swap because that seems to be the best way to minimize loss at that point.
