Mine was much worse. I also have the replica wheel and the not sure what the finish is like on side. The dealer tried to repair it but made the finish all dull then tried to hide it. I realized much later what happened.
Either way they didn't end up doing anything and I was just done dealing with them. They ****ed up my wheel after the car was there for a rear bumper repaint after they had backed it into another car.

I'd say yes. A new wheel is required.
What if any other poster here took their car in and the dealer gouged a fender or other body panel.
I can't imagine anyone would settle for a puddyed up body panel over a new one.

In owning my C63 just 2 weeks, I already have seen how difficult it is to know precisely where the front fender, let alone front tire, is when maneuvering in close quarters. With the unusual hood and fender design and complex shape, you simply cannot see the fender and therefor have no good fix on where the front tire is. I can readily see how a dealership employee could rub a wheel on a curb.
Furthermore, the low aspect ratio of the tires virtually guarantees that once a curb is encountered, the wheel is going to get marred, unless the curb height is in the "midget" category.
Knowing that, if it were my car and wheel, I honestly could not see myself holding out for a brand new wheel. A repair, yes. But not a brand new wheel.

Taken it to the dealer, inside had black marks on my leather, my white leather. Dealer apologized profusely and offered me a full interior detail. I didn't ask for a new chair, I just asked that they fix it.

I took my 7 series in for an oil change
at the BMW dealership
I did not notice that a wheel had been
scuffed when I left but when I arrived at
my friends shop 5 minutes later I noticed
it and returned to the dealership
The SA came out and looked at it and said
let's set-up a time to get it repaired
It was repaired but when I went to pick it up
you could still make out the scuff
The SA said let me get you a loaner for the night
and the wheel will be finished right tomorrow
I got a 5 series for a loaner and the next day
the wheel was good to go
I have known my SA for 20 years

I do not know this for a fact but I have been told
that many high end dealerships - MB/BMW ect...
do have insurance for customers wheels that they
may have scuffed/damaged ect
It seems that most dealerships take the same road
as the airlines do when bumping - cheap
They have the money/insurance to repair/replace
a wheel but will they do the right thing

Do you really want to fight this hard and be an *** to your dealer, or be a reasonable person, let them fix it and maybe give you a free service or something, and keep a good relationship with your SA. They remember. And if you have a big problem later, playing this one cool will pay off 10x down the road. Just my 0.02.

+1 on BLKROKTs and others suggestions that you ask them to fix it. That is so minute that it's like asking for a new car - not just a repaint because it *might* not match perfectly - because of a small rock chip or a pigeon pooing on the hood while the car was in their possession. It's not structural, it's not going to result in any kind of diminished value and you won't be able to notice anything after the fix.
