Nope. And not because "cops are pigs that get away with murder." Rather, because he was being assaulted with a deadly weapon and feared for his life. How/why he (the cop) got into that situation is mute at this point. But again, that's just playing what if and we could do that all day.

Not to belabor the point, but using your rational, cops should just avoid situations where someone is acting in or using something in a "very irresponsible manner"? Saw these posts rolling through the live feed and thought, folks are trying to fault the LEO? – or trying to excuse the behavior of the driver? - strange rationale to me.

What our young legal scholar is forgetting is that in our judicial system, your defense almost completely depends on being able to afford the right attorney. This has been confirmed in numerous studies. There are attorneys who could probably get this idiot essentially a slap on the wrist, unfortunately those attorneys would charge more than the cost of a new C63.

What our young legal scholar is forgetting is that in our judicial system, your defense almost completely depends on being able to afford the right attorney. This has been confirmed in numerous studies. There are attorneys who could probably get this idiot essentially a slap on the wrist, fortunately those attorneys would charge more than the cost of a new C63.

Sounds like you're heading towards being a defense attorney? I'm not even close to being able to call myself an attorney but I've watched "My Cousin Vinny" enough to be confident I'd beat you in a court room here. Because you're leaving out so, so much. Since you like imagining things...
Imagine someone with a camera yells "Jump off that bridge! Mad YouTube hits yo!" Do you jump? Just because someone with a camera says do something it doesn't mean that it is okay or legal. Harming people or not, it's still considered illegal and dangerous especially in the epicenter of a city with 8 million people. Now, as you drive away with that awesome burnout footage, yeah, a police officer walks in front of your vehicle with his hand out directing you to stop. Now, why wouldn't someone obey the officer at this point? Is it A) Because they just did a super awesome harmless legal burnout and they just wanted to chat it up with the officer OR B) Because they just did a super not awesome burnout (pffftttt get an LSD, scrub) which they KNOW they shouldn't have done and they KNOW this because their following ACTIONS prove it. I mean, why flee like that if you're just going to get a high five from a cop who say "Sick burnout bro! And awesome car!"
Cant pay your fines? You drive a c63... Can't pay your bills? You drive a c63... Can't take care of your family? You drive a c63... And who says they can't pay? I believe the term is speculation but you may still be down in the 101's... You'll get there.

I am not a future defense attorney. Not my interest nor my forte, I just took an interest to this since I am a part of the community. Also, a C63 is what... 40k max now? A well-optioned Honda Accord could cost slightly more.

Well here's what I would argue to that, if a cop is truly afraid for his life, why would you stand in front of a car whose driver is clearly acting in a very irresponsible manner? No one is defending the actions of the idiot driver, more so, questioning why the officer decided that way the best way to handle the situation?

I'm simply playing devil's advocate here since everyone is so quick to assume they're heading to prison, and I am arguing from a legal standpoint that the obvious common sense argument is not always the one that wins.

Your example is hardly reflective of a real world situation. My point was that panic is a factor, and it is not to be ruled out so quickly. Regarding previous arrests and all of that mess, I wasn't aware of their history and was simply going off of the footage. That, obviously, may change things. For the sake of argument, if they both have relatively clean records, chances are they'd be getting off pretty easy here. Anyway, your logic on intent is flawed, but I don't have the time now to continue posting here about this. It has been beat over the head and we'll see what happens.

Panic is no excuse, sorry. And you're also assuming they panicked. I buy the panic defense maybe from someone with minimal run-ins with the law. These guys, and their past, have zero respect for the badge and knew exactly what they were doing. They knew they got caught, hate the police, have gotten away before, so did it again.

I am not a lawyer, but a law student. I've done a lot of arguing since no one wants to take an educated opinion seriously on Facebook, but there is a VERY high chance that he gets away with this. Watch the video again. Now here are a few things to consider: 1. it is dark out, there are lights shining in your eyes in Times Square. 2. He did not attempt to run the officer over, but instead attempted to drive around the office - prompting the officer to jump back in front of the car. Now there are a million rebuttals to these two statements, but I am fully confident that as long as this guy gets a decent attorney, he is not going to jail. Will he face some pretty harsh consequences? Yes. But he is not going to jail. I think people have to step away from their biases and put themselves in the place of the driver before passing judgement, and then look objectively at the situation from both sides before saying "This ****ing ******* should have been shot the moment he inched forward."
Unfortunately guys confused is correct in one major thing, beating this case is not impossibe. I asked my attorney about this and he said its not an impossible case to beat and that he could beat it. Another thing most wont know is that video will get thrown out in court, you cannot make out who was driving so that video is gone. These jokers had plenty of time to talk to the right attorney and get it all down in order to walk from this. There is more that i wont share but given the fact they got away, had that time, the video can get tossed and having a good attorney, this case can be beat. I mean lets be real here, we have seen other cases get beat that were much worse than this lol
