Hello, i’m looking to purchase this 2017 C63s and had the seller take it in a for a pre purchase inspection, during the inspection they found an oil leak they said it’s 100% not the oil pan and that it looks like it’s coming from the top half of the motor. What do you guys think it could be?

All good turbos have an oil leak or two. This one looks standard timing covers ($1k).
Don't mind the cosmetic scratches. Cheap to deal with. Focus on repairs $5k+ so you don't endup over a barrel in August. Before you consider this car you need cylinders inspection :
bore SCOPE AND COMPRESSIONS.
Chassis fault scan

This is the rear main seal leak, I had it happened to me at 80,000 km mileage, so the engine needs to be take down and the seal needs to be replaced, but the cause of this issue is most likely related to the vacuum pump and PCV(or pcv pipes that got blocked), the repair is roughly around CAD $3000 - $4000
