Due to the way these engines are manufactured and shipped to various assembly plants around the world, it's hard to pinpoint by model year. However, it's very doubtful you'd have a MY2008 with an engine in the range. It could have happened with some models made outside of Germany (like the W203 - they are made in plants on almost every continent) due to timing with engine shipments, but the German factories operate on JIT so they would have the "freshest" engines.

And FYI, the class action suit did not include many vehicles that were made with affected engines. That's what happens in these cases - lawyers with little to know mechanical or manufacturing knowledge blast away with class-action suits in hopes of winning millions.
