Well it definitely has the new outside mirrors (CLS type) and they neatly tucked in the rear bumper. On second thought, after thinking about it, the mirrors and rear bumper do resemble the new S and, in fact, this may very well be a new s rather than an E!

I think the second picture is the new S, although the fender flares don't look large enough. That red strip has to be to cover up the Silver Star, as if informed people on the highway couldn't tell what kind of car it is.

Seems like the side mirrors on both of those vehicles are different. The bottom vehicle seems to come more to a point. Guessing different models.
But then again, it might just be the camera angle?

That doesn't look anything like the current E class. If it is, I would characterize it as an overhaul, rather than a "freshening up". We all know that the new E wont be out for at least 3-4 years and any changes in the interim will be minor (I think).

The trunk lid rises above its opening, like the new S-class and the Acura RL, but unlike the current style:

... That's a fairly extensive change, since it seems to involve the rear fenders as well as the trunk lid itself, and goes beyond what I would expect of a mid-generation "freshening."
... Or maybe it is the next S-Class. But why would M-B still be taping it, unless the picture is old?

Thanks for sharing the photo. I don't really like the new S. I guess I like the more classic look, which explains why I bought an E. I have a feeling the revamped E will be more suitable to my taste, yet again.

Well, I have to say that I kind of like the new S. It looks as if the two in the delivery center are the short wheelbase. I would bet that the longer wheelbase will look better.
I usually notice that these new cars look better in person than in pictures. I think that I will keep my 04 E 320 4-M for a long time. I might sell the Audi (in a few years) and buy the first V8 CDI S class that is made available in the US. This way I will have an economical highway cruiser and an AWD sedan that gets OK mileage for winter.
I am sure that the picture was an S class,

If indeed is the S Class then, why would Car and Driver say it's the new E?

As far as the new S fender flares...I do not like them at all! The car looks great from the front but the side views do not inspire me.
