Paint is crackling

Today I was getting out of my car, something on the lower end of the fender behind the wheel, I see a black crackling look. I looked closer and the paint is crackled and looked like ready to peel. I'm freaking pissed since the car is an 03 with only 43k on the clock. I'm wondering where does Mercedes stand on this and is this covered beyond the 4yr/50k mile basic warranty cuz I looked up in my owner's manual where they cover on the rusting under the paint. Anyone have this problem and know what recourse I have with MBUSA?

Is it the paint or the protective foil they put on for gravel chips?

It's the actual paint, I don't see any protective foil. I'll post a pic as soon the weekend comes and you can share your opinion what kind of damage I'll be hit with, I have a irky feeling that they will have to sand it down and prime it and repaint it.

alright here's the pics attached, since I finally took it this afternoon, my friend think it looked like it was touched up before, which I think he's right but it wasn't there before when I acquired the car. We have been getting a wet season in july and August. I think something probably caused this. ARGH how do i attach the pic, since it says i have to attach through a URL, which I don't have.
