New E350, Old Nav software
It seem that MB should provide 2008 owners the updated SW at no charge when it becomes available since they can't provide a current release with a new car. As the nav box says "Mercedes-Benz offers new, updated navigations discs annually with the most current data available", etc.
Does this seem like an unreasonable request?

Sometimes new NavUpdate discs have proven to be incompatible with the software on your Nav/Comand unit, which causes immediate weird display/audio system problems requiring a visit to the Dealer to have the NAV/Comand software updated so that it all works together. While that's not a huge deal, it does take time to bring the car in, and pick up later. Plus its aggravating to slip in a disc & have it screw up the works on the "pride of the fleet" on a Friday afternoon.
I plan to keep my almost 1 year old '07 3 more years and I will never replace the Nav Disc. Their cost versus the improved info on them is not that discernable a difference to justify the outlay.

From the above responses, your expectation level is so low all that you would hope for is a bug free release. My expecation would be that they "morally" owe us an updated, correct version, not a 2 year old one. I definitely was not asking for a copy of the buggy 2007.1 but the new, corrected one, when released.
I guess that I need to adjust my expectation level for MB. Looks like they have not trained me yet.
