2005 E320 CDI in California?

I recently totaled my '02 CLK430 after getting cut off in a rotary.

As much as I miss it, I think my next car will be a 2005 E320 CDI. My concern stems from my plan to move to California. I've read that the '05 and '06 CDI's are illegal in CA, but I've also seen several for sale there, and spoken to a dealer in Oakland who has one on the lot.

Can anyone clarify this issue for me? If I buy an '05 CDI will I be able to register, insure, pass inspection, and legally drive in CA?

E320CDI, CLK55, and a Smart
I have a 2006 E320CDI and it is legal here in CA.

There is one caveat. The car needs to be "used". CA DMV law defines used as a car that has over 7,500 miles.

You will have to get it smog checked here, but its nothing more than just a visual test. They do not plug into the OBD2 port or dyno or do the sniffer test.

Insurability is no problem.

Any comments or things to look out for when buying one of these cars? How's the reliability, sound, smell? The only diesel I've ever driven was a 2000 ford f250 so my diesel experience has been skewed on the loud and smelly side.
