I wanted to say something along those lines but didn't want to create havoc here in this forum. I've gotta hand it to ya...You got brass ones . Regardless, I hope all goes well with viesel.

According to what I've heard, in order for you to "void" any warranty, the dealership must be able to prove that any modification that was done was the direct cause of the problem.

Now we (and they) know that simply changing wheels and/or mounting shorter spring do not make 'turbo surge.'
Chipping might , but we have been before told that this problem was there prior to that modification.

IMHO, if there was that problem prior to the 'chipping,' that modification should have been postponed until the problem was corrected. Just my cautious prudent nature, you understand!

Again, the dealer must prove that any computer changes that were done caused the problem. Simple enough to replace the cars' computer with a brand new one, and if there then is no more turbo surging, Viesel is out the price of the new computer, but at least the problem is fixed! Then he would have to go after whoever did the computer modification.

Are you in touch with a MBZ rep on the corporate level?

I had the ecu removed back to stock a long time ago only because I got a little worried about all this. The service manager told me that the ecu was working properly, they checked it. So my only modifications are the brabus springs wheels and tinted window. They know all about my mods, They were even impressed with it. The actual problem with the car started about 5 days into ownership even before I had the windows tinted.

Now they cannot say that what you did causes the problem that you are having!

I hope that you be able to get them to replace those two wheels. Were they driving?

Keeping you up rather late. Problem like this tend to make me loose sleep also.

The dealer insisted on me coming in and taking them out to do the test drive. I refused many times and told them I already have test driven with them numerous times,until MB corporate in NJ called me yesterday and told me to just go in and drive with them again. I told them this will be the last time I will go in to show them again what is happening with the car. So when I got there this morning they insisted on me driving while they watch the computer. Go here, turn there, go down this street, keep it in third, and punch it, turn here, and go back, and floor it, just over the slight hill was 3 massive pot holes. Yes I was driving and doing exactly what they wated me to do! I feel if I didnt have to go in again and show them what was wrong then all this would never have happend. These roads in that area are roads that the airport will be taking over in the future, so the city has not done any work on for ages. They are really bad. I blame the dealer, I did what they said.

The problem you now have is that you have an engine with a problem that is very rare indeed. No doubt Mercedes-Benz have checked their database to see if any 320CDI engine Worldwide has had a similar problem????? Has the 'chip' company checked theirs?????????

To chip such an excellent engine is a gamble, and when you gamble, you take a chance. I accept that you have now removed the chip, but the damage might have already been done. This MUST be a warning to anyone who is considering a similar deed.

I hope you are successful with your claim for the wheel and tyre, but remember, the 'Captain' is ALWAYS in command.

Sorry if I appear negative especially as I was so supportive at the outset. Unfortunately I must have been poorly when you posted your 'chip' post.
