You need to serve them with a registered notice that you are looking for remedy via lemon law. And the clock is ticking.
Copy that to mb headquarters in NJ and let the dealer know you are in contact with NJ HQ. And the NYAG office.

As far as I remember, in PA you need to have 3 written up complaints for the same issue (within the first 12 months of ownership). These need to be documented by the dealer. If after that, the problem is still not rectafied... you have a very strong case. No lawyer fees...they get paid by the automobile manufacturer. Good luck.
After they lemon'ed my W211, I spoke to a bunch of people and have heard stories of them lemoning a MB after 4 years of ownership and returning ALL of the payments back for ALL 4 years.

NJ HQ is actually USA HQ for MBUSA and should be listed in your operator's manual or call toll free number listed in your manual.
If talk to a lemon lawyer, make sure his cut comes from MB and not out of your settlement.

The company I went thru only got paid when I received a settlement. No settlement, no fee to the lawyer. And that lawyer fee was paid directly to the lawyer by MB and was not a part of my settlement.
