I didn't see anything in the T's and C's for MBrace like what is described in the article above, but it wouldn't surprise me if they continue to collect data on vehicles where there is no active subscription (like mine).
Can anyone confirm whether this is true and if it is, is there an opt-out that needs to be pursued (like OnStar)? As a last resort, is there a brute-force hack to disable the Mbrace radio altogether?

Isn't there a separate fuse for the MBrace radio?

Although I'm not a lawyer I would think that if they're in contact with your car even though you've opted against paying for their service it could be argued that they have a duty to,for example,respond to an accident even though you're not paying...or that they're obliged to offer stolen vehicle tracking without being paid.If I was on a jury presented with such a scenario I'd rule against GM...or any other car maker offering a similar feature (MB,BMW,Lexus,etc).
