Driving with tailgate open?

I would like to transport 10ft long 2x4s in my 2014 wagon. I assume my rear hatch would need to be open. Has anyone driven with the hatch open successfully?

I've driven short distances with the rear hatch open but not fully open. I close it down just enough so it touches the top of the stuff I was transporting (fence panels). Only went about 10 miles and didn't go over 40mph. got a constant warning on the dash about tailgate open though.
