Will I pass Inspection with Muffler Cutouts in NJ?

Hello, This thread is not specifically W212 but just in general in NJ.
So far I got a resonator delete with H-pipe in place. It was very minimal that I was considering muffler delete
But I found out about muffler cutouts and I'm thinking of installing them soon !
I was looking up here and there and got to this problem, which is NJ requires any motor vehicles to have muffler in an operation condition.
I have few of my mates who got their muffler delete and says it's not a problem.

So it says "No person should use a muffler cutout upon a motor vehicle on a highway" than would I be ok to have a muffler cutouts on my exhaust and still be able to pass the inspection as long as they are not in use / valve closed ?
