Another data point...
Being that I'm one that sometimes has the tailgate not close (<10% of the time), and am not annoyed enough to bother the dealer, here is my experience.
These are my closing remarks.

- I always get a hard close if something else is open to relieve back pressure (doors, windows, sunroof, etc)
- I can get a soft close, or a hard close, or a no close if everything is shut tightly
- A 'no close' seems to always be that the stage 2 of the closure failed to launch and stage 1 wasn't enough to close it.
- A 'no close' is much, much more likely in cold weather.
- Sometimes a 'no close' becomes a soft close as soon as you start moving the vehicle
These are my closing remarks.

I think it was solved in '09. I haven't had any problems in the 12 months I've owned mine.
My only concern is that I have 3 little ones that like to play with keychains. A GL parked in a garage + a 4 year old with a key chain in the house = a scratch/dent in the liftgate. Fortunately this hasn't happened to me yet but I'm trying to be very vigilant about where I keep the keys.
I have managed twice to open the liftgate inadvertantly by carrying boxes and luggage which pushed on the key while it was in my pocket. Fortunately my garage door was open both times and no damage was done. Actually, this was how I found out that I could open the liftgate fully while my GL was in the garage with only about an 1" of clearance to spare. Those of you with new GL's, beware!

LOL, I just got a 4 inch scratch on my GL350 which I bought in December. I recently spent a fortune to get it fixed. I'm surprised that the Gl has no resistance sensor. It caught my hand once and it would not stop!

I had very irregular behavior on my 07.
My '10 has always acted the same (normal), every time I close it. And, that annoying chime as it closes is a thing of the past (happily)
