Leaning (sagging) to the right
Forgive me if this has been discussed. I did not see any mention in the search
I notice when i look at my car from the rear end it has a considerable lean to the passenger side. I would say maybe an inch or more. Is this a sign of a strut going? Would this be a warranty repair under the CPO coverage? any help is appreciated.

Check coil spring on that corner, carefully and with a good flashlight. Especially near the top and bottom mounting locations.
(Unless you have the airmatic suspension and the air bag on that side is busted/leaking.)

"Spent" isn't the right term.
You're looking for a broken coil spring. Most common points of breakage are near the top or bottom mounting location.

Make sure all tires are at same pressure. Hard to see the difference between 30 psi and 40 psi. Then on a flat surface measure the height of the rear and front bumper on the left and right side. Is it only the back or both front and back? If there is 1" difference take it back to the dealer and get them to fix it. You either have a soft spring, a broken spring, or some other piece of suspension that is not right, either bent or broken. Do you have a CarFax? Was this car in an accident? If it is CPO you should have unlimited millage for an extra year on the original warranty. Bad vehicle geometry can affect the tire wear, alignment handling and safety of the vehicle.

Just FYI: CPO warranty is not like "new car" warranty, and generally things like brakes and suspension are not covered. The powertrain, electronics and electric system generally are.

Interesting how different dealers can be. Maybe because I have bought 5 cars from mine but, I last November, bought a CPO with 42,000 miles and when I complained about brake vibration they replaced the rotors and pads gratis in the first month. If a spring is broken or even weak, I would hope the dealer would replace it on CPO. The new tires that were on the vehicle were covered for a road flat under tire warranty. They even have a service discount program. So as Andreigbs says, it all depends on how much repeat business the dealer wants. I am sure mine would work with you on what is wrong if he sold the vehicle.

I have decides that I would ride it out. Sometimes It looks like the passenger side is down, some other surfaces it looks fine. I out a level to the bumper and it does show a tiny bit off. not sure if my mind is playing with me because the floor or a ceiling beam in my garage may not be level.
