Is there any type of air intake for an 04 ML500 that does not void the MB warantee?

I would think that any problem down the road that could be attributed to a change in the air inlet would not be warranted. These could be water ingestion, dirt ingestion or just premature failure of the MAF sensor, etc. Also keep in mind that you will not be able to detect any improvement in performance even if there is one claimed by the mfg. You are wasting your money, just give it to a good charity.
