Seat Warmers -- Defect Investigation?

According to this site, NHTSA has opened up an investigation into consumer complaints about being overcooked by their MB seat warmers:

Has anyone experienced or heard of this? The seats on my car definitely get warm if you set them on level III, so I usually do not go over II.

Was ist dieser ungerade Geruch? Brennt etwas? Heilige Scheiße, denke ich, dass mein Kolben auf Feuer ist!

Mine are fine on my '08 CDI, but my previous X5 had the same problem. It was a bad thermostat in the seat that caused the problem on the X5.
