Initiated Lemon Law proceedings on '09

I initiated Lemon Law proceedings on my 2009 ML350 w/ 5,000 miles. This vehicle has provided a terribly troublesome, anxious and grueling vehicle ownership experience.

It has been brought in over eleven times for major service. In spite of MB having the vehicle in service over an aggregate time of 1 1/2 months, they have completely failed to repair the major problems.

Also, don't look or expect MB to help you or accomodate you in any way when you put your foot down. They DON'T. IMO and experience, they have and are proving themselves to be nothing like they portray themselves in media or when purchase is made. Their promises and assurances of quality, warrantee and ownership satisfaction have proven to be vacuous and are pure smoke and mirrors. The consumer is left high and dry with their defectively designed and built vehicle. Hopefully, the Lemon Law process will bear positive results for this consumer.

Buying a Mercedes has truly proven to be a very painful MISTAKE.

care to go into detail on what your problems were and what state you are in ?

I just went through MB buying my ml back a week ago so maybe I can help

You do not mention what faults were the cause of your action. Any reason this was not mentioned??
I for one have owned 3 ML's since 1998 and my 4th will be picked up Thursday. All have been OK with the 06 ML500 so far being the best and the 98 ML320 being just fine. With my 02 ML500 there were some issues that were resolved each time by my fine dealer with no inconvience to me as they picked up the car and left a loaner and the reverse when it was fixed. None have ever let me down on the road nor have any of them put me in any sort of a dangerous situation. I also have had 2 E's since 2001 with a third on order for Feb delivery. The best is my current 2005 E320 4Matic and the 01 E320 4Matic was also very good.
I do hope that my 2010 ML550 is as good as my 06 has been as its been flawless. Perhaps your dissatisfaction is due to an incompetent dealer or abuse by whoever drives it. After all you are in the minority.

I am seriously interested in your lemon issues, could you explain in detail for the rest of us so we can make informed decisions.

I have been happy so far with my '06 ML but I am all ears.

wait weren't you the person who complained about the ml being unstable at freeway speed ? if you are why did you but another ml again

I'm actually quite impressed with MB when it comes to satisfying their customers.
Mercedes-Benz USA bought back my GL450 for a full amount of $81,000, after the car had been in two accidents, and wasn't having repeat issues. Just one big one, due to the dealership, that could've caused my wife to be in a large accident, but wasn't.

I completely disagree with everything you've said after "failed to repair the major problems." I truly am sorry to see that you're having a horrible time and wish you the best of luck.

It has a lot to do with the particular dealer.

But, I imagine it's possible to have a problem buried so deep it basically can't be fixed and this is the solution. There is NOT a design defect, simply a manufacturing glitch. Understanding, of course that given it's a made-in-Alabama car the problem probably lies with an American manufacturer of some subcomponent.

Poster provides no evidence he's gone beyond the dealer and actually to Mercedes with the problem.

Even if he has, remanufacturing the car is NOT a solution, and Lemon Law refund is perfectly good business.

This is the same guy who was "terrified" in driving his vehicle a few months back, when you say Major Service, could you share what problems in particular have impeded this vehicle and rendered it to be part of the lemon law, we are all very curious to your details as many of us have this vehicle at home and it may educate us and prepare us for what possibly major could go wrong. As a member of this forum it would be greatly appreciated and expected as most of us use this type of forum to educate ourselves of the investment we've made, thanks Skytop. Hope it all works out.

My take is that the problem he claims is not the vehicle but the driver. Have a look at all of his prior posts and formulate your own opinion. I say his driving skills are at fault even though he claims to be a ex SCCA Race car driver. I can duplicate his issue with My ML500 just by intentionally over controlling the vehicle. This guy seems to be unhappy about everything. Quite frankly if it goes to court he should not win the case if MB takes a hard stance.

Sosh, you are probably right, who on this forum comes out and bashes and cuts up his vehicle and claims that he has had all these major services and doesnt come back to the forum to (a) defend himself (b) illustrate in detail the "major Services" , I dont think he is a troll, but I definetely think he is not trustworthy due to his no shows.
