ML320CDI W164 2006 Does not start

Hi my ML does not start on cranking. Had the problem 2 weeks ago and the workshop it was towed to told me that the key had lost its pairing and that they got it going by holding the key against the little IR window on the driver door handle.
It is dead again and the spare key or the key regularly used don't start it and holding the key against the door handle does nothing. I believe that this was misdiagnosed by the workshop as the car should have given me a message saying something
to the effect that the key was not recognised. With the car starting at the workshop and then running fine for a few days it leads me to believe that the problem is intermittent a faulty relay maybe?
I have an ok scan tool which is the Autel MD808P which shows no codes. I can get my hands on a better scan tool.
I have checked that the diesel filter is getting fuel by disconnecting the out pipe from the filter to see diesel spurting out. Diesel filter is new. Can the pressure from the diesel tanks electrical fuel pump be low causing this problem? Or would low pressure from the tank still let
the car start but affect performance?
The 1st time it went off I was driving up a slight incline and the engine cut out similar to me running out of gas. It does have diesel as I topped up with 5 litres of diesel thinking what if the fuel gauge is faulty?
Where else can I look?
Thanks for your help in advance.

Cheers,
Andrew

ML320 CDI 2006
Hi, this may or may not help but....
Last month I privately bought an M320 w164 2006 and all was well for a week or so, then, when I tried to start the car in the morning, the starter would turn over the motor once and then stop. The doors unlocked remotely ok and the little red lamp flashed when the buttons were pressed.
After about 15ish goes eventually the engine started on that first and only turn over. I thought this was attributed to the weather, as when motor the warmed it started ok on that first try.
I scanned it with a carsoft scanner and it was all clear except for a couple of can bus communication fails. Cleared those and as expected the problem was still there the next day.
This went on for a week or so with me trying various things, paralleled the battery, checked earths etc etc.
Then by chance I picked up my second set of keys and lo and behold, the car turned over about 4 or 5 times and started. I thought maybe a fluke but car was ok the next day too.
Changed back to the original keys and the fault returned, BUG*ER ME was the thought at the time.
Replaced the batteries in the key fob and all has been good for 3 days now on the original fob.
If there are any techies out there who understand where the key fob fits into the start up procedure, why everything else worked i.e. glow plugs, fuel pump etc, why it failed with one turn over, and do you think those canbus errors would have pointed to the ignition switch/key fob had I not deleted them before investigating? I would appreciate it.
As an aside, the reason I deleted the canbus errors is because I had a Saab which regularly threw these but unless they were accompanied by another error then they meant nothing.
Familiarity breeds contempt I suppose!!
Hope this helps someone out there

Hi Andrew, not a lot of help yet, so, this is the YT video from DTech Engineering called

This is the direction I was going to go in before I found the battery issue.
There are others on You Tube especially from "Mercedes Benz Specialist"
and maybe more importantly

Your symptoms were different to mine so they may be irrelevant, but at least the reply may have bumped the subject up a bit

So have checked the EIS (I have the older version) and replaced the Crank Position Sensor but to no avail.

Got a better scan tool from a friend and get the message this message under the Check Drive Authorisation section

Synchronization of control module n73 (EIS [EZS] control unit)and N3/9 (CDI Control unit) is being performed: No

Under the Starter Rotates and Engine Does not Start Test I see :
Synchronisation Status : Not Initialised
