Tailgate Opening issue W166 ML 350 2013

Tailgate is not opening with the Remote key either from outside or inside. I tried opening the door using the emergency release steeps.
i did open it manually. Now when i press the red button under the tailgate it tries to close it automatically then I stopped it and tried the button from the outside and the tailgate fully opened automatically.
If i close it, I won't be able to open it until I do the emergency release again.
Is it a program issue ?
