If you buy your disc from the dealer and experience this problem, he may do the interim update fix free.
You can also get nav DVDs through Navteq (unfortunately they are now charging the same as the dealer - about $275; they used to be $50 less). However, if you need the interim update, the dealer may not do it free if you get it through Navteq. However, the update disc sells for about $12.00 or so. The part number for the nav service disc could have changed, because it may now contain even more recent interim updates.

I have a 05' S55 can i update the command/Navi software and if so how can i do it?

The post to which you responded makes it pretty much intuitive, especially if you followed the link. The DIY: Buy the interim update disc and the COMAND update disc, and follow the instructions. The interim update disc is placed into your Nav DVD reader, and the COMAND update disc is used in the COMAND reader. The COMAND update disc may have to run for 45 minutes or so. It is not necessary to perform the COMAND update in order to do the Nav interim updates. The COMAND update gives you ETA and provides the "bird's eye view" option on some COMANDs - but it disables access to the engineering menu or "secret" menu some folks like to talk about. Last, insert the new Nav DVD.
The other way is have the dealer do it for you, or take Oxygen up on his offer.
