Transmission program button

I have 2 questions about the Automatic Shift Program button "C/S" near the COMAND controller.
The manual says to change modes only when the transmission is in Park.
I thought this was merely a program change.
Does something physically change in the transmission when switching between comfort and sport modes?
Will any damage occur if you press this without being in Park?

The manual also says it will stay in the mode you left it for the next restart.
Mine always reverts back to comfort mode when I start the car.
Is there a way to make this stay?

According to my owner's manual (2013 S550 4-Matic):
- you can change between C & S at any time. The car will always start in C.
- for AMG vehicles you have to switch to / from M (manual) only while in Park. But the car will start in "E" every time.
