I do not think it is coincidence that Mercedes is dropping most V8 models in the US, while continuing to provide V8’s to other countries and to Austin Martin and Jaguar.
MY 2022 would not be impacted according to the White House:

Consistent with the President’s Day One Executive Order, the Environmental Protection Agency (EPA) and U.S. Department of Transportation’s National Highway Traffic Safety Administration (NHTSA) will announce how they are addressing the previous administration’s harmful rollbacks of near-term fuel efficiency and emissions standards. The two agencies’ standards work in a compatible fashion through model year 2026, with the NHTSA proposed rule starting in model year 2024 and the EPA proposed rule taking effect a year sooner with model year 2023.

There are a number of rules under review on how the fuel efficiency and emission standards will be calculated. The EPA and NHTSA as you pointed out, are not in agreement on the model year (2023 or 2024) for the new standards to begin. (Note that the emission standards are different than the mileage standards). The President’s Day One Executive Order instructed that the Trump emission and mileage standards be rolled back up immediately, which would have an affect on model year 2022. Some of the more stringent standards are likely to be delayed for a year. In any case, the CAFE fine is being increased from $5.50 to $14.00 for each 1/10 mile under the standard for model year 2022 and it is still in place. And Mercedes is far from meeting either the old or the proposed new mileage standard, they are also having difficulties meeting exhaust emission standards with their high horsepower engines. My new 2021 S Class has an average Mileage of 20 MPG, half of the current requirement. Mercedes needs to do something now or they will be paying tens of millions more in fines in model year 2022 than what they are paying this year.

The chart contained in the article (you can click on it for an expanded view and also click on each orange dot for more details) shows light car CAFE jumps from 38 mpg in 2021 to 42 mpg in 2022 as it now stands. The average cost to manufactures for compliance with this standard is shown to be $2400. Add in the fines for non compliance and you are talking big money. Many of us wondered why Mercedes did not make our new S Class a 2022 model…the increased standards and fines for model year 2022 go a long way in explaining why.
