get the car on a lift and inspect it yourself. This act alone puts power into your hands when negotiating price and prepares you for the next 50k miles on the car. I would also ask for service history print out.
p.s. I never heard of a " performance pack", i mean, isn't this what AMG S63 is?!?

I would take it to a dealer and have them perform a PPI and tell you what the car would need to be CPO'd. That will give you an idea of maintenance costs. I would also do a search on issues with the 63 motor on this site.

Depends on the dealer. Normally they won't sell you a warranty unless you buy the car from them. That being said, Theoretically if you do all of the service that is needed to get the car up to cpo spec(that is a lot) at the dealer, they may make enough money on the deal to figure out how to sell you a cert. It might be cheaper to find a comprehensive extended warranty aftermarket from a reputable company, like from Bruce at Becks import who sponsors on this board. I have no experience with him but a number of people have used him if you do a quick search on the board. Most of your questions will be answered on the E63 portion of the board, w211 chassis, a much more active section than this. Good luck.

No this is not common. I have no issues w/ mine @ 57K miles. You have to read between the lines sometimes; people panic, people spread rumors and this lawsuit original started w/ one guy leasing an '07 E-class E63, then bunch of people all of a sudden got stupid and heard noises. I wouldn't sweat it too much. I don't think a dealer would CPO anything over 50k though, but what do I know, I'm not in that field.

good thing for forum notifications. Shortly after I made the post above, i ended up offloading my s63 due to knocking in the block at almost 59k miles. I am glad i did because along with that, i found out my brakes front, were shot (were last done @ 47k miles on mine) and the rear seal on the diff was leaking. I regret making the post, the car is gone now. I am glad i got rid of it when i did. Apparently the car was made to really go good until warranty goes, then all bets are off. Just a money pit in my opinion & experience.
