Can you guys give me some advice on what to do?

Hey guy, just need some advice on what I should do.

I placed an order for a 2005 SL500 in the beginning of October 2004. The order was placed thru the Sales Director at a Bmw Dealership where me and my family frequently bought cars from. The guy told me it would take 8 weeks for the car to arrive, so I confirmed the order and gave him $5000 around mid October as a deposit. He told me he'll give me a production number once it's in the system.

By mid January, I called again to check on the status of the car.. he didn't give me a production number, but claims the car is to arrive by beginning of February.

By the end of February, I called again.. and this time he told me the car was to arrive the following week. 2 weeks later, still no car. By now I was started to get fustrated, I called him once more and he told me by the end of Feb, I will have my car.

First week of March, still no car. So I called the manager of my leasing company (who happens to be good friends with the Sales Director) to find out the status of my car. He calls me back and said the car won't arrive for another 3 weeks.

I got so mad that this guy keeps giving me false dates, so I went to his office and told him I wanted to cancel my order. He claims the car is arriving soon and that I was getting the deal of a lifetime. The car I ordered with options was $146k (Cad) retail, the price he was giving me was $143k. However, he said that there were additional options worth $3k free to me (wood steering wheel, keyless go). and that in reality, I was getting a car worth $149. I never cared for those options, nor do I want the wood steering wheel (I had chosen aluminum trim).

Since I'm paying the money for a brand new car, shouldn't I get a car with the options I had choosen and nothing more? I am so mad at what's happening that I'd rather cancel the order and reorder from someone else. What's worse is, he told me if I cancel my order, I'd only recieve $4000 of my $5000 deposit. Is there anything I can do in this situation? Or is this just how the system works?

Sorry about the long post, but some suggestions would definately help.

I am very confused. I assume you are living in the USA...or maybe you are not.

In the USA, SL500's are not $143,000.

Secondly, am I to understand that you ordered a Mercedes from a BMW dealer.

I am confused. Got me.

Nope. It appears he is in Canada based on (CAD) after his price figure.

As far as I know the deposit is a no obligation agreement and they turn it to you if you cance the order ( in US works that way) but in canada Idon't know.

I know a lot of dealers that take orders with $5,000 non-refundable deposits. Just depends on the market and what they can get.

Plenty of takers for that deal. Remember when the 2003 SL was introduced people were paying $10,000 to $30,000 over MSRP. Imagine that.

It depends on the laws of the state, in TN, you can get your deposit back. In some states they have laws where the dealer can not charge over MSRP.

An old saying

If it looks like SH*T and smells like SH*T, it is probably SH*T!

I would dump that dealer in a hearbeat.

If the car has stuff on it that you did not sign for on the initial order, by most laws you can walk away and get your deposit back. What they did is fraud. Even though it is free, you did not ordered it. Talk to the sales manager and tell them that my want my deposited back or we go to court. Tell them I did not sign for the extras.

Here is a fully loaded car with out the desino package in Canada. You also need to go to a real Mercedes dealer.

OPTIONAL EQUIPMENT
Paint:
Alabaster White No Charge

Upholstery:
Premium leather in Charcoal No Charge

Interior Options:
Active Ventilated seats. $1,290
Integrated Motorola V60i™ tri-band digital portable telephone. $3,620
Leather and wood trimmed steering wheel. $935

Exterior Options:
Bi-Xenon headlamps. $410
Distronic adaptive cruise control. $3,770
Keyless Go vehicle entry and starting system. $1,865
Onboard tire-pressure monitoring system. $960
Panorama glass roof. $2,585
Parktronic parking assistance system. $1,550

Option Total: $16,985
Base Price: $131,300
Configuration Price: $148,285

Thanks for the reply guys..

LovinSL600: I ordered from the BMW sales manager because my family has been purchasing their last 5 cars from him. He claims he can get any car for us, at a really good deal. And yes, I'm from canada and prices are quoted in Cad.

Tiggerfink: I ordered my car with the following options,

OPTIONAL EQUIPMENT
Packages:
AMG Sport Package $8,995

Paint:
Black No Charge

Upholstery:
Premium leather in Charcoal No Charge

Interior Options:
Interior trim in aluminium. No Charge

Exterior Options:
Bi-Xenon headlamps. $410
Panorama glass roof. $2,585
Parktronic parking assistance system. $1,550

Option Total: $13,540
Base Price: $131,300
Configuration Price: $144,840

That, plus pdi and freight was supposedly $146,000

All this guy is doing is getting a car from your local Benz dealer and selling it to you. I am sure he makes money as well being the middle man. If he is telling you that you are getting a wood wheel than you are not getting the aluminium interior you requested. I would go to the BMW dealer and speak to the manager and get your deposit back.

I agree with Juice it. Your purchase request is specific. They need to honor it. Otherwise, no deal.
