ABC Pump Issues - Dealer Lying!??

hey guys, have an accident in the car several months ago and took it to the local benz dealer .. they fixed the car and missed a strut leak that i mentioned to them, they did replace one strut but it seems to still be leaking also...the car was dropping down to one side when i would park it and then all of the sudden the ABC light and do not drive light came on..the car dropped down on the right side so far on the fender well that i could not drive the car, had it towed and the dealer said the ABC pump is not working..i am trying to get them to cover it since the repairs werent done properly..the service manager told me that the pump doesnt work any harder whether the fluid is low or not and that the pump is always running no matter what the fluid level is etc...i was always under the impression from reading here that low fluid and out of fluid can cause the pump to burn up..and this is what i think happened..can someone w this knowledge clarify.
