Received a call from the Detective this morning not more than an hour prior to the court start time telling me that it had been pushed back and that I would receive a Subpoena to the new court date when it was decided when it would be. Typical American justice system for you.

The legal system sucks *****.
Why is it taking so long to get the car repaired? The legal system and court case is one thing, repairing the car is another. In this situation, shouldn't your insurance repair the car and then go after this guy for their costs? Have they even given you a rental car which would cost them more money the longer the delay?
I luckily haven't had an accident yet, but that's how it's always worked out for my friends. Plus whenever they demanded a rental car, the insurance would bust their @ss and try to get the car repaired quickly just to reduce their costs.

I could help you here in Vegas, but not in LA-LA land. Did you find counsel? I can try to find someone, but the prior posts are right, he most likely has no money or insurance, or very little of both. As far a criminal stuff, they push back pre-lims all the time. I have a DUI death case that has been pending for 2 yrs now with no prelim (fyi a pre lim is like the grand jury...it is the hearing to determine if the State is gong fwd).

The car has $30K damage and the shop I took it to initially tore it down only to find that they didnt have the right equipment to complete the repair. So I had it towed down to San Diego, to Phil Thearle's Autowerks who repaired my E55 last year after I was rear ended by an idiot kid. They do amazing work and it was a mistake on my part not to get the car down there in the first place but I wasnt sure how long I was going to keep it and thought maybe it would be totalled so I didnt care who repaired it as long as the shop was decent.
Anyway, the man who was assigned to repair the car at Phil Thearle's, their best guy for Mercedes, has two jobs ahead of him before he can start on my car. That and the fact that the car arrived to them already torn down means that they now have to figure out exactly what they are going to need for the repair which is difficult because the car arrived already pulled apart. This whole thing is a nightmare. I cannot wait to be past it all.

I heard about this shop last year and its grand opening in Santee. Isn't it a division of MBWerks aka Autowerks Direct? Will you be keeping the car after the repairs or trading it in for a new CLS55?

Man, you insurance adjuster sucks, you need to look for better insurance company in the future. ;-(
I see cars like yours on the salvage auctions all the time, with a lot less damage and they were totaled.
Are they going to compensate for lost value or anything??
Can you ask a body shop guy to help you and declare it total loss??
Tell them that it will be unsafe or smth like that.
This is not a Camry or Accord…….;-(

Mainroman, believe me, I have tried everything to get it totalled. The insurance company said that the damage would have to equal at least half the value of the car for them to total it. This is where I start thinking back about how much I wish I would have rammed this f*ck back as then it would be a total. I am in the middle, just like awlays. The car is badly damaged to the point where I want to unload it as soon as possible, but its not damaged enough to yield a new car. The same thing happened with my E55. I am always in between.
If I had just split after he hit me the first time(I was sure even at that point that it was intentional), I would be out of a fender and thats it. But instead I stayed and waited for him as I saw that he was turning around and I assumed he was cominng to deal with the situation. Turns out that he was coming to deal with the situation, just not in a way that anyone would have believed! So here I am, 3-4 months away from getting the car back, and my insurance company, Progressive(they suck), will only cover 30 days of rental coverage all while I am looking for a job (sales position at a dealership). I am so totally screwed.
I have been doing a lot of thinking about what to replace this car with. I am still considering a CLS63 030 car but I am also mighty interested in the R35 Nissan GT-R thats to be sold here in late '07/early '08. Who knows, at this point, I just wish I had the 55 back, fixed or not.

The damage actually is not that big and totally fixable. 30k is the insurance estimate and they pay by the book. Labour on this car is like 5-6k tops!!

I don't know what your current situation is - but I think you need to sue your insurance that's for sure. And once you get the car back, don't make mistake of trading it in or selling it to the dealership!!!!!!!!
They will only screw you more. Sell it private party.
BTW how's the case going?? How many years in prison did that guy got??
Did he have any assets to pay you and other people??

I just saw this thread for the first time and wanted to pass along my best wishes for a speedy recovery. I also hope you get something out fo this to cover all of your losses and more.
I am curious that you mentioned that you were looking for a new job as a salesman for a dealership? I know that the dealers around here do not pay near enough to afford a CLS 55. May I ask if this is what you did before, or are you just looking for a change? Good luck finding what you want. Having a job you really love makes all the difference in the world....I just have not found it yet!
