right now the status on the dispute is "temperary hold" if paypal does take money out of my bank and give it back to him after he receive the bumper I will contact the police and consider this a fraud.

I have not taken down the dispute because I have not received the bumper. Im just covering my assets here. Now if it comes in today like frankW said I will gladly pull it down.

I have been waiting for 9 days now for this to arrive, you've been waiting for a DAY for me to take out the dispute. Now you know how I feel.

And last time I check I was still out of $1220 and I dont have a bumper. As far as Im concerned Im on the downside of this transaction!!! So go ahead Frank call the police let's see what they will say.

And lastly, I did not start this thread to make FrankW look bad. I just needed to be assured that I do have a bumper which I paid for in full that I will receive. And sure enough right after I posted this thread I got a response from FrankW with a phone number of the shipping company. If he has given me all this info to begin with, All this probably would have been avoided.

And now you're holding payment hostage UNTIL you get the bumper? Wow, if only AMAZON worked that way... you buy everything, get it delivered and THEN decide if you want to pay...

Large items = freight = time. I seriously doubt Frank said you'd have it next day or in two days. Also, you wouldn't pay for something next day that size, even though you act like you would, as it would be a LOT of more money.

Hell, I ordered a trunk matt from Performance Benz 2 weeks ago... you won't find me crying to my credit card company. And as Rock mentioned, we're all waiting for MORE expensive and SMALLER rotors from EvoSport, and none of us are losing sleep over it.

Do you or do you not have tracking info? If you do, verify if it has shipped. If it has, you're done, release the paypal funds now. If you don't, that makes you pretty petty and vindictive. Even posting on this board and publicly trying to affect his business and reputation was wack to begin with... but to further this by punishing someone because you're paranoid and impatient says a lot. You say you didn't post this thread to make him look bad... give us a BREAK! That's complete BS and you know it. There's no other reason to post publicly about someone's "failure" to close a business deal.

What you did and what you're doing is wrong, period.

Frank... I'd recall the shipment and not have it delivered... just call the shipping company and have it canceled and returned if it hasn't arrived. Obviously, no matter what happens, this individual will complain about something. So even if they do get it, YOU may never see your money again either. When someone jerks you around like that, the sale isn't worth the aggravation.

Ok! I think That's what I said once i get the bumper, paypal dispute will be pulled. And once again let me say I DONT HAVE A TRACKING NUMBER!!! And Frank did say when he shipped on the 30th that I will get it by the end of that week which is the 2nd of June.

And I am not holding the payment hostage. He still has the money. I did not ask for a refund! It is in temporary hold in Paypal they will not take it out of his account unless I ask for a refund which I wont I just want my bumper that's it.

Sure you did. You publicly tried to humilate a long time member on a board I read all the time because you couldn't handle your own business with class and patience. Just the act of trying to make your laundry public by hanging Frank out to dry is in bad taste. Denying that was your goal insults all of our intelligence. Doing it on a board that is not C32 related is desperate and vindictive...

This thread is silly, why would someone drop their car off at the bodyshop without having all the parts ready to install? Then blame the vendor because they have to pay for a rental?? Who's fault is that?
Seriously having to wait 2 weeks for a bumper is pretty standard and hardly worth trashing a respected sponsor and making yourself look like an *** on multiple forums........this is the E55 forum right??

obvious...once anybody claims a dispute at paypal, paypal is the laughing third who keeps (and uses) the money...even way after disputes have been cancelled...that is how paypal operates.

just release the ebay dispute and wait like everybody else.

You are giving C32 drivers a bad rap. I do understand 1220 is quite a bit of money, but you have to act a bit more mature and dispute things directly with the 2nd party and don't get the whole community involved.

Your posting on several thread is really uncalled for and you could of ruined Frank's business, for a simple misunderstanding.

Wow, MBZAMG32, acting like that you deserve crap feedback for going so far as formally disputing things so soon!

On eBay just these few months, some of my larger purchases:
- I purchase Klipsch La Scala speakers on eBay, and it took about over 3 weeks to get it due to its size (item under one thousand $).
- I purchased my 560SL form a guy in FL. Between payment clearing, title processing, and shipping, it took over 4 weeks to get it (item under 15 thousand $).
- Now, similar to your situation, a few months before now I purchased a Butler 5-ch Tube Hybrid amp (item 2 thousand $). The guy selling it was very quick and responsive with e-mails, we talked on the phone, but he didn't send me a shipping tracking #. Then at the same time, due to a billing dispute with eBay, his account was shutdown. Though he had a huge feedback count near 100% I start worrying and writing e-mails to the seller and to eBay asking them if there's a chance I was scammed ... etc... My e-mails went unanswered for a couple of days.

The amp arrives not the next day, but day after. Everything was in-process/in-transit. For whatever reason, the dude selling could not get me the tracking number or e-mail. Maybe he was "out of town".

Whatever, I felt like a shnook! But thankfully, I never gave any seller reason to be pissed off @ me about shipping/delivery time and I got great feedback. I hope this purchase comes to a similarly positive completion.

EDIT: Thought I think it's too late for that.
QUESTION: Why do you choose to ignore the very informative accurate information posted by Loren in response #3 about how -freight- shipping operates, and with that, take a chill pill?! It's most likely the trucking company doesn't offer 'tracking'.

There something I need to clear up with this.

First of all I never "promised" that Robert will get the bumper on the 2nd which is a Friday. What I said after he has sent the money via paypal was "I have received the payment on paypal, but will only be able to take care of it the following week after memorial day weekend. Hopefully I'll have time to pack the bumper on Tuesday/30th and he should have the bumper by Friday."

Secondly, I did manage to pack the bumper on 30th and dropped it off at the trucking company the following day assuming everything is taken care of. I've also send PM to Robert stating that I'll have to see if the trucking company has a computerized "tracking system." Then comes Friday Robert sent me a PM saying he did not receive the bumper. I then checked with the trucking company AND replied Robert's PM and told him what happened by what the trucking company has told me regarding "delay."

At this time Robert sent me another PM stating why there isn't a tracking number yet and saying why couldn't I ship it by UPS or Fedex, etc. Which I replied this bumper is not mine and I'm just shipping it by what the owner of the bumper asked me to and then gave Robert the approx measurement of the box and weight as well as quote for oversize shipping via UPS which comes to around $290. I asked if he want to pay the extra amount for that I'll see if I can get the bumper back and ship it UPS. Robert did not reply on the subject. In the middle of it he told me he is driving around in a rental and needs this bumper asap.

and the next thing I know I'm reading an e-mail from paypal saying the buyer has filed for dispute and please check resolution center.

All before I had a chance to PM him regarding the issue of tracking number or trucking company information.

Now let me clear something up:

I sent payment to Frank on the 26th and he sent me a pm saying that due to memorial day he could not ship till tues.

I received a pm from Frank on the 30th saying:
I've send the bumper to shipping company and have given the shipping address to them. They'll take care of it and let me know when it's shipped. I'm promised should be no later than this week.

Now he's saying that the item was shipped on the 31st now why did he not tell me this?

So I waited, On Fri. 02jun I sent a pm to Frank:
Frank, Can you follow up with the shipping company in regards with the Brabus bumper. The shop has not received it yet. If you can get me a tracking number that would be best so that I would at least get an estimate on when I should expect it. So the body shop can set a schedule on when to paint it.

His response:
Shipping company told me they're waiting for other boxes etc. The trunk will be en route next monday. (Notice no info of shipping comp.)
So I replied:
is there any way you can use a different shipping company. This is taking way too long considering it is only coming from LA. I hope you understand my situation Im paying for my own rental right now bec. the shop has been done with my car and my insurance has stopped paying for my rental. This is just unacceptable since they told you that this bumper should be shipped by this week. And now they're saying it has not even left yet.
Frank's response:
Does your car have no front bumper on right now? The bodyshop does not need the car to have the bumper prepped and painted, so you can still drive your car. It'll take only couple hrs to install the front bumper once painted.

The bumper is already packed in their container. They're just waiting for other customers large items.(Note: still no info for shipping comp.)

My reply:
Yes! I DONT HAVE A FRONT BUMPER!!! that's why i need that bumper ASAP!!! And why cant it be shipped today instead of Monday? It's been with them for a week already. and what if the other customers items dont come in does this mean I will be waiting longer!? Can you pls. use a diff. shipping company! And PLEASE PROVIDE ME A TRACKING NUMBER!!! I paid $1220 for this, the least you could do is give me a tracking number! So that I know what exactly is happening. I probably would not have known about this if I have not emailed you about it.

Frank's response:
I'm using the shipping company the owner of the bumper want me to use. This doesn't go through my company. I'm simply accepting the money because the owner does not have paypal. I'm going to the trunking company to see if they have a tracking system available. It's already packed and in the container. They're waiting for the semi to come pick up the container. (still no info for shipping comp.)

Now on 03Jun I sent him a pm:
Why does the owner get to pick the shipping company? Im the one who paid for it! So when exactly am I going to get this bumper? Please understand my situation im in a bind here. Im paying rental and my bodyshop wants the car out because it's taking space in his garage.

Frank's response:
I'm not the owner of the bumper. I'm just helping him accepting the payment because he is not around. I understand your situation, but I'm already going out of my way around 20miles away from where I am to help him ship his bumper without making a cent since he's a personal friend. Besides the dimension for the bumper box is 70x25x20 weights approx 20-25 lbs. UPS second day is $291. It is an oversized package. You can check on ups.com for cost shipping from El Monte where his bumper is located.

If you bought it new from me/GTwerks. It would've been shipped 2-3 days after the order has gone through straight from Brabus. Once again you didn't buy this bumper from GTwerks. You bought it from c_brabus and because he's not around I'm helping him taking care of this. The trucking company he want to use is from someone he knows. You will get your bumper next week at the bodyshop.

Still no info about shipping comp. And I did not reply in regards w/ the UPS shipping since I dont want to pay for something that is already delayed if this option was given to me b4 I would have taken this route.

On Jun 5th I ask him if the bumper did ship on this day (5th of jun) no response. At this point Im worried since I have not gotten any info on the shipping comp. that's why i placed a dispute over paypal on Jun 6.

Right after I placed the dispute I got a pm from Frank:
bumper will arrive Thursday.

like I said in paypal msg which you can check on your dispute. You can contact 626-xxx-xxxx for Jason who is the owner of the trucking company. Ask for the bumper Frank is sending. Like I've said in the msg on paypal, they do not have tracking system as they usually do container by container for other company.

This was the first info i got for the shipping comp. If I had gotten this beforehand this would have been avoided.
And BTW since I got this number tried calling it several times I only got a voicemail left a msg but no call back whatsoever.

I admit I went overboard by posting this on several forums (I was influenced by a friend ) For which I apologize to FrankW. I should have given you a chance to explain, but when you started to say that this was not a purchase from you but from c_brabus, that worried me and made me think smething shady is going on because I paid for it under your name and I was assuming it will be treated like a purchase from your comp. That was the reason i bought it from you bec. of your good rep. in this forum.

Rest Assured! I will cancel the dispute once I received the bumper. Thanks again for your help and I apologize if I had offended anybody with this dilemma.

Like I've told you in the PM. I'm only accepting payment for him since he's a personal friend and not able to take care of it. I've also stated before hand that this is bumper is his before you even made the payment and have told you I'm selling it for him. Whether or not the shipping is delayed is out of my control.

and you never mentioned your car is without a bumper until I asked.

Lastly I'm taking care of payment and shipping of his bumper as a favorite. At the moment you put the dispute on the paypal on my personal account. I could've just called up the shipping company and tell them don't ship it and give you the refund since it's not even my money. The only reason I'm going through with this is because at first you sent the payment right away and then said your car has no bumper. So far, I'm only doing this out of sympathy for you right now otherwise I would've just refund you and you'd be without a bumper as well as the necessary hardwire for who knows how long. I also rather not have my friend pay for the cost for sending and then ask the shipping company to get the bumper back.

I've never had any problem selling or refunding anyone including lots of stuff that I sold off of my own car such as the AMG kit sold to Waveykat which he paid through paypal and asked me to hold it for a while before he could find a bodyshop to do the work, and when he did find a shop the bodykits were shipped to him with no problem and this was to NY.


btw, great job on posting all the PMs on public forum along with someone's PRIVATE cell phone number. I only gave you that number because I delt with the owner and he said to give you his number if you have questions.

I can't control the unexpected delays, but with all the threads you made you were already on my nerves. Now posting PRIVATE conversations on public forum you just made your day.

IF the dispute isn't cancelled by Saturday MIDNIGHT I will ask the owner of the shipping company to retrieve the bumper if it's already delivered and simply give you the refund. IF they still have delay on their part I will just tell them to hold the bumper and I will give you your refund. I will even pay out of my own pocket if they ask me to cover some charges for freight.

It is no longer worth it to try and make you happy. This is also going to your PM. You can chose to read it or not.
