MB recall flash & powerloss - Why has there not been a class-action law suit?

There must be some lawyers here who want to make some money and get this situation fixed.

My car feels like it lost 100 TQ.

Has anyone gotten MB to flash their car back to the old file?

Is it true that MB came up with this TQ limiting reflash so that the E63 does not feel like a lame duck when compared to an E55?

I'm pretty pissed and want my power back.

MB lists 469BHP on these vehicles. That flash probably resets it back to that level instead of the 500BHP that most people have before the flash. Since it most likely still produces 469BHP I doubt you would win anything in a lawsuit.

Just look at the sales numbers, when the E55 came out MSRP+$10 to $15K super hot and selling like crazy. Then the E63 MSRP-$10K for many even the deep discounts and special lease rates could not over come lack of the WOW factor in the E63. Both great cars, but the 63 is just not a $40 to $50K upgrade over the E55. So Mercedes may have detuned the E55s but to no real avail. The product of that "air pump relay" reflash backfired on MB and led to further distrust in Mercedes, many were/are pissed off to this day. As has been stated thousands of times here at MBWorld, "WE WANT AN E63TT" with at least 675 HP. and if we don't see it in 2010 it may never happen. So like many the S 65, CL 65 and SL 65 are the only real up grade in the near future.

I don't think anyone has figured a way around the torque limiter yet. I am pretty confident I own the most heavily modded 63 out there (at this time) and I am running up against the same problem. I would contact Brad or Bob at Evosport. They along with their partner Powerchip, have hundreds of hours of R & D on my 63. My car is currently making about 501whp well over 600 at the crank. Unfortunatly we hit a wall with the torque limiter, they say there is plenty more HP to be had, but the torque limiter makes it useless. They were still working on this issue with my car, but I ran out of time and had to have my car shipped back to me. I am hoping someone else will "donate" there 63 to the cause so they can get the issue figured out, I am confident they will in very short time.

Would be extremely expensive to bring to court I think.

You would have to have software experts like Powerchip give a complete before and after analysis of the software etc etc.

Then when it's all said and done, Benz would do just what timeless said, "Well we do list the hp at 469"

Just sucks man.

Do drive it though for a few hundred miles. We have had a couple reports of the car "coming back" after a few hundred after the flash (once ECU resets). Most not though.

After a few hundred, I would dyno the car and then flash from a tuner accordingly.

Set of headers and flash and these cars REALLY jump.

sanfran: The whole threat and Post #64 explain the issue with TQ limiting.

jrcart: On 63s the limit is simply cam timing and intake manifoild tuning. with 500 RWHP, car is making close to 100HP/L. It is simply out of airflow.

Not meaning to take away from anyone stating facts but this is mostly older models that suffer badly yes?
I have seen 2 pure stock 55k cars hear hit the dyno and get over 430whp and they already have the flash done form the production line so...
