Cruise control dropping out above 65mph. MB can't figure it out.

Cruise control dropping out above 65mph. MB can't figure it out.
I have stock diameter wheels.
18" with 245 40 up front and 285 30 in rear
car is lowered via star for last 2 years. Just started about 2 months ago.
i have not changed anything in about a year on my car period.
They have been trying to diagnose it and going on 3 days on this last issue.
They are claiming to have to charge me the rate if they cannot find the problem for warranty to repair.
There is no per say cruise control module to replace. It is all controlled through sensors, ecm, etc.
My questions:
Has anyone had this problem since this question was raised last?
Can anyone offer any specific advice in correcting this issue?

Is your CEL on? My my car did the same thing but it was slightly misfiring and if it detects a misfire it will cancel cruise control. How ever it still let me use cruise control under 60 mph with the misfires. Weird.
