(Another Thread on) Speeding Ticket Help - I know some of you have experience
Guys,
Has been a while since any speeding tickets, and have a perfect (I believe) driving record - since I typically take the class, or ask the judge to sentence me to the driving class.
Anyway, got 2 tickets within the last month - shame on me. They are fairly major too (about 20 over each.)
Anyway, throughout the legal troubles in my life I have always learned to plead not guilty and drag things out / the same applies here - I don't wish to plead guilty, pay the fine, and most importantly be assessed the points on my license.
So, considering hiring one lawyer to handle both. I have in the past been through a speeding ticket trial and all the jargon about radar/laser calibration got pretty in depth & confusing. Will a lawyer actually be able to overcome these obstacles? What about that "ticket assassin" deal - does it work ? A friend says a lawyer can do about as much for you in a speeding case as you can for yourself - it's more difficult to raise "reasonable doubt" or offer other scenarios like is seen & done so often in criminal cases. Speeding is literally more cut and dry - speed was clocked, person was stopped/identified, etc.
Also, interestingly enough - everytime I get a speeding ticket it really bothers me for days, don't know why. Even more so than my (more serious) criminal cases, which I don't think about nearly as much. I just hate speeding tickets!!! Thanks in advance

Take the driving classe before your court date. That will help w your first ticket. But don't expect any leniency for the second court date once the judge finds out about your prior speeding violation

I can't take class because I've already taken them multiple times, I can't even sign up before the court date because I'm ineligible. The only thing I can do is talk to prosecutor or judge right before court & ask - "if I were to plead guilty, could I then be sentenced to the class?" I've done that a bunch too.... Sometimes they allow it, sometimes not.

I got one in MD for going 72 in a 45. Cop just told me to pay the fine ($160) and no points. Depends on the cop if is a dick of course. I say do the driving course as mentioned and keep putting off your second court date. I put it off for 16 months so points came off my license.

Where are you located?
I have an aquaintance who works with the guy who started "The Ticket Clinic"
This law firm knows all the judges, the prosecuting attorneys, and the cops. Basically they work out a deal that benefits everyone before the case. You the defendant get a small break, the jurisdiction gets their money, and the attorney you hire collects a fee.
Based on your record.
You will probably not get points but will have to pay the fine in full plus court costs.
The traffic legal system is designed to generate income off the tax paying citizens, not to protect the public.
Basically you're tossing 80$ in legal fees.
Iron your suit, shave and show up for court while begging for mercy in front of the judge. They like that sort of thing.

Ask for deffered adjudication. It's a probationary period that can be granted by the judge. If you don't get another violation within the probationary period, the first ticket is dismissed and your insurance rates don't get affected. The judge may have you take a defensive driving class as part of this probation. The fact that you took defensive driving already, in order to clear a ticket, does not matter in this instance.

Can you convert it to a non-moving violation? In Missouri, you can pay double the fine and get the ticket changed to a charge that doesn't show up on insurance. I've done it once and it was pretty useful. It requires a lawyer. It is a total money grab by the courts operating hand-in-hand with lawyers, but it saves points. Ivebeen told the process is even listed on the courts website.

Located in nebraska actually.
Thanks for all the tips on trial by written declaration (thats likely what i will try), defferred adjudication (would that probation period work since i have two?), and converting to a non-moving violation (counties are money hungry like you said)....
Definitely a lot of useful information, thanks guys!!!!
