The only way to know for sure would be to check the ESL part number directly. Manufacturers hate throwing away existing parts when a new part is designed, so they will typically keep using the old parts from the bin until they are completely used up, THEN start using the new parts.
The arm rest changeover was surely another example of this same process... Though its hard to imagine that they had the exact same number of "old design" center consoles as ESLs.... It's equally likely that an early 2005 car could have the old ESL and the new console, OR that it could have the new ESL and the old console. It's impossible to know which set of old-design parts were used up first.
Can't wait for an update from Chawkins on his experiment today..... My new (old) ESL will be arriving soon and it will be great to know ahead of time that it will fix this annoying issue.![drive](https://mbworld.org/forums/images/smilies/driving.gif)

Where is the ESL located in relation to the TCU? I can check my ESL later today when I get home as again the weather forecast is calling for rain so I likely will be unable to do a video.

O6 GTOs have this same issue. Mine had it in fact. There were two fixes both pretty simple. One was a zip tie to the sensor on the back of your brake pedal shaft. You lose cruise control but can then do a burn out with brake on. Second was a simple parameter in the tune. This pisses me off. This is probably why I had a hell of a time doing consistent burn outs when I went to the track. Cant this be tuned out ?

For God's sake...... will somebody with access to an '03-'04 E55 car please pull the ESL/ESP module (right next to the TCU) and plug it into an '05-'06 E55!!!!!???

Testing completed. I have an '06 with a '04 tcu. Lets just say I can send smoke signals to aircraft at 30,000 feet with this setup. No problem roasting at will and with traction control on, its not nearly as aggressive with throttle closure. I wish I knew this years ago since in my opinion its 1000x more functional this way. Just the fact that I can do a proper burn out without dyno mode makes it worth it.

Do you have an LSD in your car, or are you still running the stock rear diff? I am still planning to plug that 2004 ESL module into my car, but I have an appointment (finally!) to get my Quaife installed and was tempted to run the car with my original ESL module and Quaife just to see how much of the "nanny syndrome" was related to the open differential (and uneven tire speeds)...... then install the 2004 unit and run the tests again.
I suppose it doesn't really matter much. Based on your feedback, I'd be silly not to install the 2004 ESL regardless of whether the Quaife helps or not.

I have a P030 limited slip sitting in my garage and was thinking the same. So the answer is no, I have a stock diff. Instead I back up the car since that forces the diff to lock and then I do my burn out and have never had trouble being one legged.

I have never attempted a burnout, however, I have tried to heat the brakes after driving in rain prior to storing the car in order to prevent rust forming on the rotors. After 2 seconds applying the brakes and throttle simultaneously, the engine shuts down. I do not have a TCU tune as yet, but suspect it would make no difference as I am guessing the logic circuit is elsewhere.

The TCU And ESL module are two different things (although they are located next to each other). For sure the TCU tune can't address this ESP issue... But it sounds like an older version of the ESL module works beautifully
