I know we all think our cars are perfect but mine vs. the moded and thrashed comps they used was pristine before the accident.
Do you have any big ticket items added to the car?
It does have 57000miles or 92000km, not a lot, but. Have they taken into account the P2 option package, not sure if I seen it on the spec sheet. Personally I would look at the other cars listed and see if they compare! You may get the insurance co to spring for the 09 if it is a better deal.
Also go to a MB dealership for another few comparisons, a CPO would be nice.If you purchased yours from a MB dealer then that where I would start.

I can't stress enough the importance of comparable vehicles. That is THE MOST IMPORTANT ELEMENT when it comes to dealing with ins companies and getting what the car is 'worth'. I was in a very similar situation with a BMW I owned. It wasn't a person I swung over to avoid hitting, but a larger raccoon or the like. Long story short without getting into details, the ins company gave comparables that were substantially lower than what I knew the car was potentially worth as it sat. Literally, they low-balled by several thousand dollars (ie think $5K+ less). But that's the adjuster/ins company's job to get it closed as efficiently and quickly and low-balled as possible. I pulled comparables from every website I know that sold that particular BMW I owned. I pulled edmunds and other car valuation reports as proof that their offer was too low. Vehicles as close to mileage, condition, options etc. as your car. I even had a lawyer draft up a short letter threatening good faith - which worked in my case as I settled for almost $6,5K more than their initial offer.
I am telling you right now, the comparables are the most crucial part of your case and getting more money. Mods, maintenance etc. might help a little, but comparable vehicles are key. It will take you time to gather all this information, but in the end, you will get several thousand dollars more from the ins company. I am speaking from experience, don't give in.
Having said this, I don't know what E63 market is like, how much they're selling for, condition and such. Their valuation might not be that far off, I am just speaking from experience of not giving in on their initial offer. Counter with backup information on comparables. If they are truly lowballing by a significant amount, threaten with good faith letter by an attorney - if needed and deserved, not because you're thinking it's worth a grand more, but something that is great deal more than their offer. Good luck, it's the biggest PITA dealing with ins companies.

This.... I tried to tell OP this in previous thread. A good insurance company will almost always pay you more than you expect. In 25 years of driving I have had farmers 90% of that time. They paid out on two cars and it was more that I had expected both times.
No, I would not take it to an indy shop to do the work. I told the dealer I wanted it fixed such that no mechanic could ever tell anything happened or I did not want it back. No non OEM parts, rebuilds, salvage or whatever. Brand new OEM or nothing.
We pay insurance to be made whole and that is what I expect.
You are not alone thinking like everyone, my car is worth more.
$38k is not bad.
