A very well known national tire store once forgot to tighten the lug nuts on my car after having the tires rotated and balanced. They took it for a "quality assessment" test drive, and the front passenger wheel shot off the car at 50 mph. Luckily nobody was hurt, but the car was damaged. Long story short, they shelled out nearly $10k to ship it back to DC from NC and have the dealership fix it, and then paid me "diminished value" on the difference between the car's worth after a carfax entry. I spoke to two lawyers, both said any judge would agree that the company performed all measures needed to demonstrate their willingness to "make it right", and any type of "emotional distress" claim would not fly for a few reasons. One, I wasn't in the car "even though I was about to be". Two, nobody was hurt. Three, all costs associated with the inconvenience factor were covered by the company, namely a rental car to drive back to DC in with my family and able to keep the rental for nearly 6 weeks while it was fixed.
NOW....if you wanted to discuss some "good will" gesture from the actually dealership you leased the car from for another one, then you might get a little more sympathy there in terms of them wanting to keep a customer. But that's likely all you'll get. MB USA won't do a thing for you, as it wasn't their fault for any of it. The dealership screwed up, not MB, and the dealership is an independent legal entity long far from reach from MB Corporate.
