You can definitely let your Insurance take care of the damages first, and let the Insurance company get the $$ back from the other party/Insurance carrier. Do you carry Uninsured motorist Insurance? I do and this is the reason for it, if the other guy's insurance lapses. In CA all drivers must carry liability Insurance, otherwise you get a ticket and 1 point on your record when you are caught by the police.

I think the problem is he will need to pay the deductible if his own insurance takes care of the car even when he is not at fault.

Kidding! But this is a terrible system where the uninsured get off with a warning and we still have to buy Underinsured/Uninsured motorist coverage and they get to drive around with suspended licenses and no state plan for liability from these slackers.

wow, that repair turned out better than i expected^
update on mine: carbon fiber diffuser will be here tomorrow, new oem bumper and other parts will be here sometime next week i suppose. then ill be taking the bumper cover to be painted
