2019 E63S Wagon may need new home

I have come up against some personal challenges and may not be able to keep the car I initially ordered 15mo ago... the legacy for me includes the factory delivery of the wrong color, then the wait and re-order of the MY19, which is now on its way. The new car has not been driven, which makes this all the more painful.
ETA is in the next few weeks, as I'm told that it is on the ship now. Specs are as follows:
E63S wagon $108,850
Selenite Grey $3,950
Acoustic Pkg $1,100
Sun Protec. $380
Lighting Pkg $800
Driver Assist $2,250
CCB $8,950
Air Balance $350
5-spoke RTP n/c
Special Order $250
Perf Exhaust $1,250
115V outlet $115 (humorous px)
Rear Airbags $420
Heated Steering $250
HUD $990
Perf Seats $2,500
3-zone climate $760
DINAMICA HL $1,600
Heated Rear seats $580
Soft close doors $550
-------------------------------------
Invoice $135,895, less the 5% FD discount.

I will get stuck paying sales tax, but am looking into whether documentation can be reversed before the car hits the shores here and can be re-documented to new buyer. This will also mean buyer doesn't buy a "used" car with 7mi on the ODO.

It pains me more than I can say to do this, but some things have fallen out of my control.
Cheers

Maybe I am misunderstanding your situation but you are not obligated to take the car legally. Dealer won't be happy but so what? Apparently you had to deal with errors on their side. Commitment is there once you have taken possession.
If they have taken a deposit, they are legally obliged to return it to you in full no matter what they might say.

It appears he already purchased the car and paid for it through factory delivery. I just completed factory delivery in November 2018 on my S63 so the process includes paying for the car before factory delivery in Germany. Once delivery occurs at the factory the car is now the buyers car. The sales tax is paid once the dealer redelivers at the state side (2nd delivery) dealer. Essentially title (certificate of origin) is already in his name. Maybe I am missing something but I think this is why he feels stuck.

Well said... I think that sums it up... I paid for the car, I don't have title as I guess it travels with the car, and at this point I don't think any of the documentation can be reversed though I have never seen this car. Perhaps this is a unique case as every other Factory Delivery requires the buyer actually go to the factory (as I did with the MY18 wagon that was the wrong color).

This may sting a little bit.

That makes sense. I didn’ t look a the FD comment but how come 7 miles? A factory delivery without driving it? That kills the benefit of going through the process.

Either way, that will sting but GLWS!

They delivered the wrong color car.

So he got to drive the wrong car for the Euro trip the MB ordered a new one, which was a MY 19, in the right color.

Ordering dealership brought back the misdelivered car and used it as a demo as I recall.

So, he ”owns” the new car but has never seen or driven it.

I think I got that all right - we used the same dealer so I got to hear some of the story.

How on earth did they deliver the wrong color car? Was it an ordering issue or a production issue? When I did my Euro Delivery I ordered the the ‘19 S63 in June 2018 with delivery in November 2018. I confirmed and reconfirmed with my dealer and MB Euro Delivery department all the options. I was involved in the process so it is hard to believe it would get ordered in the wrong color. I was involved in the e-mails between MB Euro Delivery Dept and my dealer so I am not sure how that could happen. I am very curious as I have done Euro Delivery and plan on doing Euro Delivery in the future. I want to see Peter (at the Center of Excellence again—Euro Delivery is awesome) at the Center of Excellence again but would not want the wrong color car. It is interesting as I look back at my conversations with the Center of Excellence folks that before Peter at the Center of Excellence pulled back the cover of my Ruby Black S63, he asked me what color did I think it was. Now I am wondering how many times they deliver the wrong color cars.

Yes per MBUSA one is required to pay for the vehicle 30 days before the confirmed delivery date in Germany. Some dealers allow payment just before leaving for Germany—like my dealer since I have been buying S Class cars from them for over 20 years.

When doing ED, you complete the US purchase paperwork prior to departing for Germany. In my case we did the final paperwork on Thursday or Friday and hopped on the plane Saturday. So, it wasn't like you're completing the purchase months in advance.

24 Hours will confirm, but if I remember the story correctly, he learned about the paint issue before showing up in Germany but the trip plans were all set, so he and the dealer worked out that he'd take delivery of their demo car and they would reorder the proper car, which because of the MY cutoff is now a MY19 - or something like that.

This is correct. The more pics I see in the "Random Pic Thread" the more I may just decide to live out of my new wagon, just get that pop-up roof tent. Still hoping to delete this thread by the time the car arrives. Selling the better part of my wine collection too, which may cover about half of this.

Sorry to hear about the turn of events. Really hoping you are able to keep the car somehow, especially after all the hassles you've endured. Did MB throw in anything for their mistake?

Tragic. Sorry to hear about this OP.

This reminds me of b-thumper. He ordered an M3 back in 2013. There was some sort of clerical error on the factory floor and they painted it the wrong color. He was doing a Euro Delivery as well.

https://www.m3post.com/forums/showthread.php?t=842479

Sorry to post a BMW link and story, but it's oddly relevant at this time. Maybe reading his story will at least make you feel a little less alone with regards to the situation.

Good luck, hopefully you can keep the wagon!

MB took care of us. I got to drive their car for a week in Europe for a fantastic week and then re-order later. At home I commute by train every day, so the car is largely unnecessary, and I didn't make a bigger deal out of it. I appreciate folks thoughts... I'll post pics when it arrives.
Cheers
