Mercedes-Benz settled a lawsuit over omitting “high-cost emissions warranty parts”

I was reading Autoblog and came across this: Emissions Warranty settlement. It links to the actual settlement: Hazdovac Emmissions Warranty Settlement Basically they will reimburse for up to 100% of repair, diagnosis, and replacement for qualified claims. You must have purchased or leased the vehicle in California or states that follow California's emission and pollution regulations. Parts that are covered include:
Manifold PCV Connection Assembly
Power Train Control Unit (PCM)
Accelerator Pedal Sensor
Accelerator Pedal
Partial Load Operation Crankcase Ventilation Valve
Clean Air Line
Pressure Sensor Downstream of Air Filter
Check Valve within the EVAP System
Crankcase Ventilation System
Vent Control Valve
Charcoal Canister
Fuel Tank Level Indicator Fill Level Sensors
Coolant Thermostat
ESP Electronic Stability Program Control Unit

Looks like some RMS failures should be covered.

This would be great news. I have a 2020 E63 with 15,000 miles and when the RMS goes I'm hoping it will be covered.

I am not sure if that is how it works. I think this covers repairs to the PCV or OVS systems in our cars. The suit does not make reference to any leaking seals. I do wonder though if a shop stated that the seals were blown out due to the failure of the OVS if that would not also be covered. I suspect MB will weasel out on that and only cover the OVS repair.

Potential good news.....🤨

Glad to see some acceptance by Mercedes on offering coverage to its customers...

Still wish they'd recognize the major fault that is the RMS & OVS failure in a hefty percentage of the M177 platform. Alas, this lawsuit looks like it doesn't cover us lowly 2018 MY owners. SAD face 😞

I interpreted that it did cover a 2018 as they state from 2015 forward. It appears you must be the original buyer. I'm the second owner so technically I may not be covered, though I don't care as my 2018 was fixed under warranty at no cost to me (other than the aggravation of a not so competent repair),

I don't view this as Mercedes voluntarily deciding to do the right thing. They refused fixing equipment that [California/States that follow California's rules] view as emission related. The agreement is they now have to follow those rules.

regardless, I suggest filing a claim. The worst that could happen is they tell you to go pound sand.

Apologies if I misread/misunderstood the Lawsuit.

Here are my stats:

2018 Wagon
2nd Owner (I purchased in Washington State, but living in Virginia)
47,XXX miles
No issues with leaks (KNOCK ON WOOD!!!)

I believe the lawsuit is covering vehicles within the 4yr/50,000 - 7yr/70,000 age/mileage? Which, if that's the case, then I am not eligible, nor do I think Virginia follows the same emissions standards as California.

I would think the mileage would apply to the mileage the vehicle had when the repair was done.

I had asked the question multiple times of whether anyone ever tried to claim these were emissions issues so I’m glad to see that somebody actually took them to task. The good outcome here is that now these parts are included in emissions warranties because the definition is now set.

my 2013 had the vacuum pump diaphragm fail which I replaced inexpensively so I’m not really worried about recovering any money but I also just happen to replace my boost pressure converter just as a maintenance item and actually feel that the car is responding a little bit better because it definitely has had oil come through it due to the vacuum pump. and yes, my car is an M157 but because the definition is set, I do believe people will have some good arguments for Goodwill in the future.

kudos to the person that brought the suit

I just filed a claim but do not have much hope of getting anything back for this repair. The criteria is pretty silly for reimbursement including the fact that only an MB dealer can do the repair, even though I have paperwork showing the work done by an independent MB shop.

One thing that should come out of this is if a problem pops up that involves one of the listed parts the dealer should repair it free if you're within the 7year/70K window and in a CA type state. Of course, getting the dealer to recognize that may be difficult.

correct. And I might add, we will see the requirement of dealer replacement disappear in my opinion because that’s not how repairs and warranties legally work.
