Help! Victim of hit and run! :(

Hey guys so the story is:

I parked my 2007 C230 in our assigned parking space in the garage last night. Woke up this morning and drove to school and I heard some really weird sound so I knew something was wrong. I parked at my school and notice that my side (above the passenger rear tire) was hit. I knew for sure this is from the car next to my spot in my garage because the mark was a clear indication that it happened when the other car tried to park.

I will take pictures once I leave my campus and post them up.

This is the first time that something like this happened to me. What are my options?

Thanks and appreciate all help.. I'm in Seattle, so any recommendation for a spot to get it fix would also be great!

Take pics for sure. And if the same car is there when you get back take pics of their car and see if you can get some marks of your paint on their car or vice versa so they can match the paint to see if its really that cars paint on your car or your paint on theirs. Get info on the car, like license plate number, VIN, and if the person is there ask for their insurance and information. Since its assigned parking you should be able to tell the insurance its assigned and that who parks next to you did the damage since your car was parked. If any dont do anything you'll just have to pay the deductible to get it fixed. Hopefully it'll get resolved in a timely manner.

approach the person and if any conflict just call the cops get it fixed by MB hopefully with the other guy footing the bill

Thanks guys, I uploaded the pictures. You can clearly see that from the angle that was my car was hit, it's from the other guy trying to park. They didn't even leave a note so I'm pretty sure they won't admit to it. I did, however, left a note for them. I just called the police and they're sending an officer down to take a look at it.

I called my insurance and they said to get a police report for them. Deductible is $300 they told me. Are the damages fixable and how much do you think it'll run me? I'm still a college student so I'm not sure what to do.

pictures are the most important in these types of situations. its the only way you can prove that it wasnt YOU that did the damage. because the first thing the insurance company will say is "how do we know you didnt do this yourself?" what really should have happened is taking the pictures BEFORE you even drove the car, because then they can say that you could have done it when you drove the car and its harder to prove it was someone else. insurance is weird like that, but i think youre ok because you can just park it back in your spot and then take the pictures and say you took them before you even drove. just make sure the pictures are at the scene of the accident and park your car exactly like it was, or at least close to the same position.

you shouldnt have to pay anything out of pocket, not even your deductible. the other person is who should be paying a deductible to their insurance, then their insurance company pays for the repairs because they are at fault. you just need the police report as verification and the other guys insurance info.

if you were to fix it yourself, it would definitely be more than $300 so best would be pay the deductible. but dont do that unless for whatever reason you cant get the other guys insurance to pay for it.

It's so sad I know !! I'm just waiting for the officer to come and take a look at it. I really had no idea about the damage until I drove halfway to my school. If the other guy denies all claims and don't give me his insurance info, would the police be able to help here? Sorry I'm so noob, first time something like this happen.. Thanks everyone again!

hopefully the police officer is smart enough to figure out that if your car was parked there in the garage, theres not possible way anyone else could have hit you other than the person parked next to you. just tell him its assigned parking spaces and if the guy denies it, the officer will question and pressure him until either he admits it or admits that someone else was parked in his parking space. but since it is his parking space, he will either have to take the blame or give the name of the person he allowed to park there.

you should be fine man, the cop isnt stupid, he'll know it was obviously the guy next to you so he'll take care of you

Some states are "no fault" states and insurance is a little different there on how they work it out. Also, without catching the person in the act it will be very difficult to pin this on someone unless they confess. The guy who is suppose to park there can deny it and say it could of been a visitor if he has no damage. Are there cameras in the garage?

I had this happen in a store parking lot where I went in for 10 minutes max. I came out and the whole side of my car was smashed where someone pulled in and rashed up against it. My insurance had to pay for it since like you there was no note & no witnesses.

If you have paint on their car from yours, then you can prove it... Otherwise you'll definitely get to pay the deductible, of course you can sue them in small claims court for that, but why bother.

Police just came, and there was paint on there car. Police said they can't prove it though and gave me a report number. They're trying to get in touch of the other guy. Should I give my insurance this report number now?

Try and get you apartment to give you the persons apartment number or name and information so you can file the information for them and that way they can have contact information on the person and can contact their insurance.

Actually I have an update! I spoke with the person who hit my car and they admitted it. Police report state that it's their fault. They, however, claimed they don't have insurance. Is this all good for me and I just file with my insurance?

yeah just file it with your insurance anyway. or you can have the person pay out of their pocket and take it to a body shop and get an estimate.

That sounds great! I'll call the insurance up tomorrow. I'm pretty sure having them pay the whole bill isn't going to be an option. Do you guys know if this is going on my carfax?

If you report it to your insurance company then they'll most likely report it as well and it'll get processed via Carfax within a few months time; on average. There's a definite trade-off in this situation, though.

Contacting them may depreciate the value of your car if you look to sell it in the future. That's granted the incident actually gets processed and goes on the history report. I'd just get it repaired at a quality shop that doesn't report to the insurance carrier or Carfax. Just make sure they do an excellent job because it's not too hard to tell where a car has been repainted.

Yeah make sure they blend the door and bumper when they repaint it. My friend and spot a repainted a car a mile a way, granted he's been doing it his whole life helping his dad at the shop. I'd also check your suspension just in case he hit your wheel too

Just noticed your pics, your damage almost looked like mine when a lady didnt look back at me in a parking lot reversing and decided to reverse to and hit my passenger side rear quarter panel. Est for the body shop was like 1100 or something plus a few more because she bent it in so much it rubbed my tire when I drove that it left grooves on my side wall. Body shop called insurance and persuaded them to give me new rear tires for my car lol Pocketed that money because it wasnt too bad really.

so there's a couple things going on here.

i would say try to avoid having your insurance pay it because it will get reported to carfax as sb was saying. even though the other person doesn't have insurance, they still have an obligation to pay for it. so what you need to do is get in touch with the police officer and give him the guy's info that hit the car, and the officer will give him an option. he will have to fill out a form with his insurance info(which he apparently doesn't have) and signing a statement saying he will pay for your repairs. Or he will take it to court, which he probably won't do. there is no reason for you to pay $300 for something someone else did to your car! also, i'm pretty sure that by law you are required to have at least liability insurance on your car if you own one, or at least it's that way in VA, but i think most states if not all do the same. either way, since you have the police report and now the guy has admitted it, the police can put pressure on the guy to pay for it because he has to sign that agreement.

i guess you decide what to so but it should definitely not be you that has to pay for anything here.

If they have no insurance you are outta luck. Unless this person coughs up some dough, your insurance will have to handle it. You could sue the person but you can't get blood from a stone so even with a judgment against them you may never get paid.
Your choices seem to be to get the guy who hit you to pay (unlikely), you pay outta your pocket, or let insurance handle it. Thats why you have it right?

I had a similar situation 3 years ago. Hit and run...never found driver. Took out fender, door, mirror, wheel, tire.....$8,500 damage. Fixed perfectly by fletcher jones MB. This repair may cost more than you think.

Oh snap $8.5k damage! I spoke with one of the police officer at the police department and they told me to file the report with my insurance. I'll call and ask my insurance if they can do something so I don't have to pay the deductible.

My question now is that is it safe to drive the car around while waiting for the money to fix my car? Reason I ask is because I heard some grinding sound while driving today. When going downhill or uphill and there's a bump, it seems as though the damaged spot is grinding against the tire.

Trini - it's an assigned parking garage in my apartment complex. I hate this place and can't wait to move when my lease is up.
Star Rider - Yeah, the guy looks like a crack head and already said they'll just say they don't have insurance and don't pay.
Phister - Mine is quite dented in too, I can feel it brushing against the tire while driving.
C230 Mulac - I'm pretty sure insurance is required in my state too, hopefully my insurance take them to court and get money for me lol.
RDVT4ME - Sorry to hear that man, good thing this is an assigned lot.
