I am not a lawyer, but I stayed at a Holiday Inn Express last night.

Seriously, can we get back to the issue at hand. How is the tunnel mode supposed to work? Why would you have the AC on and the windows and sunroof open? Please describe when and how it is supposed to work. Is this feature described in the owners manual? I'm not sure that we even know if it is a feature or not.

On my S-class it works as follows: with some windows and/or sunroof opened or partially opened, you press and hold the "internal air recirculation button." All the windows and sunroof close. You can then release the button.

The whizbang part is this: when you later press and hold the same button, all the windows and sunroof return to their former positions. It's pretty cool.

Thanks Whoover! Now, has anyone been able to get it to work? If so, where are you from?

You have no suit on you because in the catalogue, it says features are subject to change. They will say you didn't read the fine print.

Let it go. You have a fantastic car, despite the omission of this feature. Don't let this taint your enjoyment of the car.
You are right, what does this guy think we own a Nissan? When they said that the Z came with leather seats and it turned out that only the part that your butt sat on was leather not the entire seat, Nissan had to settle a large lawsuit.

It might be bad advise to tell him to let it go.

Wait, they settled? So it did not go all the way to trial?

Without a link to the previous/referenced statement one can only presume that they trialed (sp?) it and found it lacking in the tryles (sp?).

This happened in the eighties. After that all car ads said "leather seating areas". I am sure if you google this you will find the story.

I know someonr that works at MB Corp. My 08 C350 does not have tunnel mode. The website says it does and so does the lit. However you will not find anything in the owners manual.

One note: my friend at corp says that all the coponents need for this feature ARE still in the car and none were removed and is looking into why the features was de-activated before production. It can not be re-activated in DAS

that is not entirely true. Most dealers will need a code to activate this feature. But if you have access to the laptop the special techs have and/or someone with the neccessary password list it should be capable.

that the car does not bring.
It seems sir, that your "year of research" was insufficient.
heck, it only took me and my wife about 15 minutes of sitting in the car to realize that some of these important features were lacking in this $40K car. One of the pet peeves we have with our "top of the line" Highlander Hybrid is the lack of memory seats so the FIRST thing we looked for in this car was....missing? Salesman says "Take the C350 for a drive". We said..."No thanks". No lawsuit, no angst. Had I ordered it and learned that it didn't have memory seats, I would never had even taken possession so "Why did you"?

where are you lawyers from?

i live in california and with the consumer protection laws that exist here this would be a very viable issue and quite similar to the cases my firm banks off of.

The arbitrary deletion of features without active notice is pretty shady IMO... There appears very little consumer protection in this area...

For example, it is not just the C350... my 2008 S600 which is actively marketed with "every option as standard" is also missing an extensively promoted feature/option (Parking Assist) even though that feature is even listed on my vehicles dealer inventory printout which was the basis on which I placed my order...

It does seem to me the onus should be on the manufacturer to point out at the time of sale that a specific feature is missing rather than the onus being on the customer to spot it is missing... (Hopefully your Tunnel Mode is there though - just hidden)

If we're going to split (stupid) hairs, shouldn't it be banks FROM?

not splitting hairs dude, just stating some cold hard facts. in all honesty i believe that it's an abuse of the system but its the truth. consumer protection laws in california are so heavily construed in favor of the consuming public that you can almost literally bring a class action suit for anything.

Contract Law 101

Has anyone had the service rep or sales person/manager go through all of the features of the car on delivery, or do you go home and play?

I have never bought a new one, and if I don't find me a rich woman, I probably won't have a new one.(NO COMMENTERS)
BUT if I were to buy a new MB/car, I'd want to know how and what the features were, that I was paying the price to receive.
In other words compensation for value. Isn't that contract law 101?

This is interesting. I had the remote windows and sunroof feature on my Passat activated by a device sold to me for $50 by ECS Tuning. I plugged it into my OBD II port for 60 seconds and had the feature.

I also looked forward to tunnel mode. It's in the brochure too. However, my car doesn't do it either.

Interesting. If I'm reading this right, some US based folks have it and some don't? Or is it just no US C class have it? Wondering if this is like the turn down mirror thing, where MB doesn't tell you that they've removed the option (only in the US)?

Is there anyplace where all the enabled/disabled options/features by region are posted? I'm down to making a decision between an '08 E and an Infinity M and would like to really know what I am and am not in for. So far it's been difficult to really know. Haven't experienced this "elimination of advertised features" with any other manufacturer so I only need it for the MB. Didn't used to be this way with MB.
