If they say no, call MBUSA right away and get the regional service manager involved. Even if the battery in the car goes bad, it shouldn't lose the code. Something is wrong for sure, and perhaps its a problem with Johnson Controls, but nonetheless, get MBUSA involved if the dealer gives you the runaround.

I've reprogrammed it 3-4 times exactly per the instructions in the manual, including clearing out the memory. I get the feeling that a lot of folks have trouble programming these things, because my SA offered to send out a "concierge" to assist with the programming process at my home - but I'm 100% sure it was programmed correctly, since it works fine for a short time and then stops working.

I thought my brand new 2011 C300 has the same problem of intermittently forgetting the programmed code. After I read the manual again I found the key has to be in position "2" for the homelink to operates. It is different from my other Japanese cars which always has power on homelink device.
It's a bit inconvenient but I guess the logic behind it is that, if the car is parked outside the garage, nobody is home. Even if the bad guy breaks the car, garage door can't be opened...

Hmm, this thread is interesting. Just two or three weeks ago, the Homelink in my 2008 forgot the codes to both doors after having worked perfectly for three years. A day or two after that I happened to pull up to a red light behind a car that was especially shiny and reflective and I noticed that my headlights weren't on (I have DRLs set to on). So I thumbed through the cluster settings and found the DRL setting was off after also having been on for three years. Every other setting was fine but something caused just the Homelink and the DRLs to get unset. I have no idea what happened.
