THIS IS COMEPLETELY UNJUST! I HAVE 2 SEPERATE SERVICES WITH DOCUMENTATION WELL WITHIN THE 12,000 MILE 1 YEAR LIMIT FOR REPLACEMENT WHERE I COMPLAINED ABOUT EXCESSIVE DUST AND EXCESSIVE SQUEALING, BUT I GOT DENIED BY THE DEALER BECAUSE I AM AT 14,000 MILES AND 1 3/4 YEARS!!! I FOLLOWED UP WITH MBUSA BUT THEY DENIED ME TOO AND SAID THAT IT DOESNT MATTER THAT I COMPLAINED BEFORE THE WARRANTY WAS UP, & THAT THE BOTTOM LINE WAS THAT THE WARRANTY WAS UP NOW WHEN I FOUND OUT THERE WERE UPDATED PARTS THAT FIXED THE ISSUE!

THIS IS EXTREMELY BAD CUSTOMER SERVICE... I HAVE 75% LIFE LEFT ACCORDING TO THE INSPECTION I JUST RECEIVED AT THE DEALER YESTERDAY ON MY ORIGINAL BREAK PADS, SO IT IS NOT LIKE I AM USING THIS TO GET FREE PADS FOR MY OLD WORN OUT ONES...

I JUST WANT THE EXCESSIVE BRAKE DUST TO GO AWAY AND FEEL THEY SHOULD COVER IT AS A MATTER OF PRINCIPLE SINCE I HAD COMPLAINED ABOUT IT WELL WITHIN THE WARRANTY PERIOD

DO YOU GUYS THINK I SHOULD TAKE THIS FARTHER AND FAX IN DOCUMENTATION OF MY ORIGINAL COMPLAINTS WITHIN THE WARRANTY PERIOD TO A HIGHER AUTHORITY IN MERCEDES BENZ OR SHOULD I JUST GIVE UP?

THOSE WHO GOT IT REPLACED BEING SLIGHTLY OVER 12,000 MILES ARE LUCKY!!!

Set up appointment for the dealership to check my CEL that came on(I'm guessing o2 sensors since I didn't go limp). Already told them exactly the tsb number of the brake pad issue and will see if they will honor it. Will keep you updated.

9800mi, 24th month of ownership.

I'm normally pretty good in reasoning with service people since I was in customer service a long time ago. Persistence, patience, politeness, and sincerity always pays off. Well, that and telling them that you will give them 5/5 stars on the survey works too.

good luck man getting it at 24 months... i was very polite too but they just recommened i call mbusa first so they could for sure get reimbursed...

then mbusa denied me... hope it works for you so i can use it as more evidence to try to get mine approved!

Changing brake pads is a relatively inexpensive service. Maybe you could compromise with the dealer and pay for the pads and let them do the labor for free or vice versa?

You would very likely win in "small claims court", but not a good idea to **** off your only dealer, if that's the case.

ya they quoted me $209 for the new pads installed.... a decent chunk o change when i have 75% life on my original pads

Seems to me like it's a wholely dealership call as MBUSA no longer replaces rear pads for free since it has been over 12 months since issue/MY08 production. Kind of bull**** if you ask me since I was never aware of this bulletin until a year after I had my car.

Ended up just paying the labor to get them to replace it, however they didn't have the pads in stock and had to order it.

Sadly, the squeaks and the cleaning I have to endure to keep rears decent looking is enough to justify just paying to get that done. I too had 75% life on my pads.

how much did labor cost? anybody know any dealers in so cal that will do this if u are slightly over 12000 and complained before the warranty was up???

Same price as yours quoted, however, I did manage to squeeze a free set of 5mm rear spring pads.

I dropped my car off at the dealer this morning and here's the scoop :

Good news - this is the correct information :

Replace rear break pads under warranty for excessive dust and squeal for vehicles manufactured before June 2008:

Part number 005-420-42-20

Bad news - he could not replace mine because my car is over a year old ( June 2008 ) and over 12,000 miles ( barely )

Good news guys. I submitted a complaint to MBUSA via their website a few days ago and just a few hours ago got a call from a rep from customer relations of MBUSA headquarters. She looked at the bulletin and confirms that for cars manufactured before June of 2008 but she said NO WHERE does it say 12 months / 12,000 miles. She will escalate with the local dealership here and see what they can do. Hopefully they can refund my money on the pads and install them for free.

I have also told her that many others around the country have the same problems and they were flat out rejected by their dealerships.

I suggest you folks file a similar complaint also.

If your car was manufactured before June of 2008, you are covered. Some MY09's were manufactured then.

I believe you check your production plate on the drivers side door.

Just checked. It says 06/08 at the top right of the sticker.
I'm guessing that's the month and year.
Am I still eligible for this?

I don't know. I would email MBUSA first before going to the dealer as they have more "power" than dealers do.

The dealers won't do it on their own nickel so MBUSA has to say forget the time and mileage restrictions and just cover the cost which they were doing earlier.

That's what the dealer will tell them.

Please let us know how this shakes out.

When I brought my car in Wednesday, the service advisor told me that since the warrantee on the brake pads was 12 months / 12k miles, he could not replace them for free regardless of the TSB. I am really interested to hear your results...

I'm getting mine done today. My car has 3K miles on it but was built in 2/08. I just bought it as a CPO. The servicing dealer looked into it and is doing it for me as goodwill.

Either way, I'm pleased it is being addressed. Thanks to all for the info.

MBUSA is going to cover my brakes being done. Supposedly from the call last week, according to the reps, they don't see a 12k mi/12 month disclaimer on the bulletin. The only date they see is based on C Classes produced before June 2008.

My suggestion is to write a letter(limited to 1000 characters) from the MBUSA contact us site. You will get a call in a few days. Be polite, explain the situation, don't accuse them of anything. Provide your VIN so they can confirm the production date. Level headed is the way to go. Remember to thank them afterwards.

Ironically, I got a letter from MBUSA headquarters this week with something about providing the best satisfaction possible for the car. Not sure if it was related to my email to them.
