Important thing is, get yourself checked out and make sure you're OK.

Consider suing or filing a claim with his insurance company only. That means the incident will not appear on your companies record.

Also, sue for diminished value of your car. This means your car even with a class 1/2 repair is not worth that of an undamaged car. You'll need an eval of the dv from a few MB dealers. dV is a standard part of tort law.

I hope you are ok and the medical insurance to you should be fairly straightforward.

If you file the claim through your company they will NOT subrogate for diminished value and they label you a trouble maker in their database.

I hope your doing fine and for that a$$hole he won't be receiving jail time cause his charge is probably gonna get reduced and his license only suspended for like 3 months and this is usually how they do it in NY.
