Tire Question!!
I've recently bought new wheels and tires, they stated brand new, i bought them from usarim.com after getting a flat and a bent wheel i had to replace, not knowing that the two front tires were manufactured in 2010 along with the rears in 2011, i was wondering if it was illegal to sell me tires that were manufactured in 2010 as new ? due to the nature of them being old, there is a blister popping out on one of them and the one i got replaced has old rubber inside of it that looks like sand, What should i do? and is it illegal? should i demand new tires ? HELPPPP

There is no official law that would prohibit a sale of a tire that was manufactured some time ago as new. Therefore, it is not illegal. So you can't send them back just because of this. However, if there are physical defects with the tire, then that in itself would be grounds for replacement/exchange. Of course often times it may be hard to prove after the fact whether a "blister" was a result of a tire defect or you running over a pothole.

Just call them up and be nice explaining that you are unsatisfied that they sent you tires that appear to have been laying around for too long, that the compound silicates appear dried out after 2.5 years, and although the rubber tread is new, you fear that you are NOT going to extract your monies worth from these tires... that the sidewalls and possibly the tread compound will dry before the tread wears out! Contact the manufacturer as well and ask their opinion. Contact the BBB, and TireRack for their input as well.

Just because a tire is unused doesn't mean it's new. In a number of instances, consumers have purchased "new" tires at retail stores only to find out later that they were manufactured years earlier. In addition to having a shorter life on the road, a tire that's supposedly new but is actually old may be past its warranty period.
If you buy tires and soon after discover that they're actually a few years old, you have the right to request newer ones, Zielinski says. Any reputable store should be willing to make amends. "It is fair for a consumer to expect that 'new' is not several years old," he says.

But, for an overall analysis, the other side of the discussion would suggest that if the OP drives enough mileage that the tires would wear out in two to three years, he would be well within the 6-10 year age range when concerns start to arise. So, one could also question if tires from 2010 are, in actuality, a problem worth the time and effort to address.

How is it false advertising? If you go to Best Buy and purchase a new TV today that was manufactured in 2011, is that false advertising and illegal? If you buy new motor oil that was made in 2011 or 2010, is that false advertising? It's still a new product in a sense that it has never been used. We're not talking about milk or eggs here. These products (tires, oil, etc.) have very long shelf life (10 years?), so it's not that big of a deal if you drive a good amount of miles each year. But if you're not happy, call them up and complain. You've got nothing to lose. I was just pointing out that there is no law that you can reference. I think most tire manufacturers will consider tires no older than 3 years to still be "new" for the purposes of new tire sales.
